Senator Mark Kelly Rebukes Army Secretary
In a bold move, Arizona Senator Mark Kelly has addressed Secretary of the Army Pete Hegseth in a letter of reprimand, claiming Hegseth encouraged service members to disregard “illegal orders” and threatened to strip military retirement benefits as a form of punishment.
Kelly, a Democrat and former Navy captain, has accused Hegseth and the Pentagon of engaging in an “unconstitutional and legally baseless lawsuit” against him, asserting that it’s a reaction to his dissenting opinions.
“This is about targeting what I earned after 25 years in the military, and it infringes on my rights as both an American and a veteran,” Kelly stated.
He expressed concern that Hegseth’s actions send a worrying message to veterans: speaking out against the president or defense secretary could result in punishment or even prosecution.
Last week, Hegseth announced that the Navy started a review process aimed at demoting Kelly and cutting his severance pay, which only adds intensity to the situation.
In a controversial video released last November, Kelly was among six Democratic veterans who urged military personnel to disregard illegal orders, without specifying what those orders were. Hegseth deemed this conduct “seditious.”
Interestingly, Hegseth’s focus seems to be solely on Kelly, possibly because the other five individuals, including a former CIA employee and four active service members, fall outside his jurisdiction.
Kelly’s lawsuit argues that the First Amendment rights of senators are being compromised, referencing the Constitution’s Speech and Debate Clause that shields lawmakers from liability while conducting official duties.
“Before any legal action commenced, the president had already labeled Senator Kelly a traitor and called for repercussions,” Kelly noted, adding that Hegseth not only echoed these severe accusations but also announced an investigation.
The lawsuit emphasizes, “Any review that follows is predetermined and unconstitutional; the government cannot pre-announce a decision and then subject anyone to a mere formality to carry it out.”
Kelly’s complaint also points to social media criticisms directed at Trump and a notable 2016 clip featuring Hegseth, where he stated that military personnel must reject illegal commands due to accountability.
The senator from Arizona is pursuing a legal declaration to deem Hegseth’s actions illegal, requesting that the U.S. District Court for the District of Columbia intervene.
The Department of Defense has been approached for comments on this unfolding situation.
