Sen. Mark Kelly Sues Army Secretary Over Demotions

Senator Mark Kelly from Arizona, a former naval officer, has taken legal action against the Department of the Army and Secretary of the Army, Pete Hegseth. This lawsuit stems from Kelly, alongside several other prominent Democrats, encouraging service members in a video message to “reject illegal orders.” The case, filed in Washington, D.C., also includes the Navy, the Department of Defense, and Secretary of the Navy John Phelan as defendants.

The lawsuit claims that actions taken during the Trump administration breach the Constitution’s protections for legislative independence. It also highlights that such military sanctions against a congressional member due to political speech are historically unprecedented.

Kelly’s legal troubles began after he, along with five other Democrats, in a November video urged military personnel to refuse illegal orders. The video stressed their duty in such situations. Hegseth attempted to demote Kelly’s retirement rank and benefits, citing that Kelly’s comments undermined military order and discipline. Such letters typically serve as warnings and can justify further reductions in rank or benefits.

In a statement shared on X, Kelly described the actions against him as an “unconstitutional campaign,” warning that this sends a troubling message to veterans. He stated, “If you express a viewpoint that the President and the Secretary of Defense find objectionable, you face censure, threats of demotion, and even the risk of prosecution.” Kelly emphasized the principle that military ranks are earned through service, sacrifice, and respect.

He also criticized Hegseth’s intentions, suggesting it threatens long-serving veterans’ stability and respect. Kelly’s concerns highlight a broader issue regarding the treatment of military personnel who express dissenting views.

When Kelly’s video was released, officials reminded him that being a sitting senator does not exempt him from accountability. In that video, he and other lawmakers asserted that refusing illegal orders is not just permissible but a legal obligation.

Following these events, the Pentagon began an investigation into Kelly for alleged serious misconduct. The situation escalated when former President Trump commented on the matter, labeling the actions of the lawmakers as “sedition” and calling for accountability.
