Martha’s Vineyard babysitter charged with manslaughter in death of 3-year-old

The nanny at Martha's vineyard was charged with manslaughter after leaving two young children in the SUV for hours in the SUV, allegedly dead, leaving one of the children behind.

According to an arrest report from Massachusetts State Police, 41-year-old Amy Cotton was arrested by authorities on March 13 on suspicion of assault and battery against a child in reckless danger.

When one of her three-year-old children died on March 19, she was later charged with manslaughter. The child is not named.

Cotton called police early in the afternoon of March 13, reporting that “the child she was babysitting was not breathing and blue.” The Oaks Bluff Police Department first answered the call and warned the state police, which arrived shortly thereafter.

The victim was initially taken to the emergency room at Vineyard Hospital in Martha, and later taken to Massachusetts General Hospital in danger by a Boston Medflight helicopter.

The victim passed away six days later.

The arrest report shows that Cotton first responds to officers that she and her children had a relatively normal morning.

She took the kids home, where they played with toys and had lunch, and shortly after the afternoon she explained that she began loading the car into the car, then changed the child's diaper before placing them in the car.

Cotton, who was called a “co-op,” told police that the children were in the car alone within 15 minutes, and said they called police around 1:15pm because one of the children looked “sick and sick.”

Shortly afterwards, police obtained cameras at the nest house with cotton permission, which contained surveillance footage from outside the house.

The footage told me something completely different.

Police said cotton could be seen entering the 2021 Chevrolet Tahoe driveway around 9:15am. She allegedly spent 10 minutes unloading items from the car and putting them inside, but neither child was taken out of the car.

Police said nearly three hours had passed without activity in the nest footage before hockey equipment began loading into the SUV around noon. Over the next hour, she loaded the car and brought in a brief younger child who had survived in the house for about 10 minutes before returning the child to the car.

That's when she calls 911 to report an unresponsive victim.

The next morning, the statetrooper brought cotton for questioning, where she surrendered and told officers that she left the child in the car for about three hours while she cooked her own food, attended personal hygiene, stuffed her son's hockey equipment and completed other chores.

The arrest report stated that while Cotton showed regret, he also made excuses for her actions.

She was first arrested on March 14 for assault and battery against a child at reckless risk. She was booked to the Dukes County Jail and was arrested later that day.

On March 20, the day after the child died, she was arrested in Edgartown District Court on manslaughter charges.

Cotton pleaded not guilty to manslaughter charges and posted a $21,000 bail. She was released on a GPS ankle monitor. She was also given a curfew at 6pm.

If convicted, cotton can last up to 20 years in prison. Her next court date is scheduled for April 3rd.

Cotton's lawyer, Harrison Barrow III, declined to comment.
