Former Prosecutor Sues Trump Administration Over Dismissal

Mohren Comey, a former U.S. prosecutor known for her involvement in cases against Jeffrey Epstein and Ghislaine Maxwell, has filed a lawsuit against the Trump administration following her unexpected firing from the Department of Justice.

Comey, who had been with the U.S. Attorney’s Office in the Southern District of New York since 2015, was dismissed earlier this year. She claims the termination was politically motivated and illegal, partly because her father, James Comey, once served as the FBI director.

In her lawsuit, Comey’s attorney argues that her ousting contravened several provisions of the Civil Service Reform Act, which aims to protect federal employees, including career prosecutors. The complaint also references violations of the First and Fifth Amendments to the U.S. Constitution.

The legal team claims that the reasons for Comey’s dismissal seemed rooted in political bias, pointing to both her parentage and her own political beliefs. As per the allegations, the decision to terminate her was made hastily and without adequate cause.

“No valid explanation has been provided for Ms. Comey’s firing,” her lawyer stated. “The only clear reasons may relate to her family background or political affiliations—or possibly both.” The lawsuit emphasizes her prior accomplishments, highlighting numerous awards and recognitions during her tenure.

It’s noteworthy that the day before her firing, Comey was assigned to lead a significant public corruption case, an indication, according to her lawyers, of the suddenness of her removal. She received notification of her dismissal via email the following day, which failed to specify reasons for the termination but referred vaguely to “section 2” of the commander’s authority.

Moreover, the complaint suggests that her dismissal is beyond the legal authority granted to executives, tagging it as “ultravirus,” meaning it exceeded the legal limits of authority. Her counsel argues that such actions could undermine the rights of civil servants and violate established laws meant to maintain a balance of power within the government.

The Department of Justice has chosen not to comment on the ongoing litigation, which names several defendants, including Attorney General Pamela Bondi and the Office of Personnel Management, among others.

Intriguingly, this legal battle unfolds amid a long-standing clash between President Donald Trump and James Comey, stemming from the latter’s controversial exit from the FBI in 2017. The tension has resulted in ongoing scrutiny, with Trump persistently criticizing Comey and even initiating a criminal investigation into him and former CIA director John Brennan for allegedly misleading Congress.

Comey’s lawsuit seeks reinstatement and back pay. Reflecting on her dismissal, she expressed a dire warning in a farewell email to a colleague, indicating the repercussions that firing a career prosecutor without cause could have on the integrity of the judicial system.

“If a career prosecutor could be fired for no reason, it could create a chilling effect on the decisions of those who remain,” she cautioned.
