Chicago and New York Mayors Unite Against Trump Administration’s Welfare Regulation

Chicago’s Democrat Mayor Brandon Johnson has teamed up with New York Mayor Zohran Mamdani to challenge the Trump administration in court, aiming to safeguard both legal and illegal migrants’ access to U.S. welfare programs. Johnson describes these migrants as, perhaps, an “essential part of who we are.”

The lawsuit focuses on the revocation of the “public charge” rule, reinstated by Trump’s administration, which could hinder legal immigrants from obtaining green cards if they have previously utilized any form of welfare, such as subsidized healthcare, food stamps, or public housing. Democrats argue against this rule, contending that all migrants, irrespective of their economic contributions, deserve welfare support from U.S. taxpayers.

This rule is intended to ensure that new migrants can become self-sufficient and contribute positively to society, rather than relying solely on public assistance. Yet, in a recent statement regarding the lawsuit, Johnson emphasized that migrants—both illegal and legal—play a vital role in America’s identity and that their access to welfare programs should not be compromised.

Johnson expressed concerns that the reinstatement of the rule disregards over a century of established law and federal guidelines that have clarified how public charge decisions should be made. He asserted that the rule unlawfully broadens government authority in assessing an immigrant’s use of public benefits, allowing for arbitrary and possibly discriminatory decisions.

In his remarks, Johnson insisted that providing support for “immigrant families” aligns with America’s responsibilities. He stated that Chicago would not remain passive while federal policies force immigrant families to decide between basic needs like food, medical care, or maintaining their legal status.

“This rule is not only cruel, it is unlawful, and it threatens the health and safety of our entire city,” he insisted. “Over half a million Chicagoans were born outside the U.S. They are our neighbors and integral to our identity. Chicago has confronted these challenges before, and together with New York and other cities nationwide, we will stand firm again. We will utilize every resource to defend our immigrant communities and their right to live with dignity and without fear,” Johnson added.

Interestingly, Mayor Johnson hasn’t differentiated between legal and illegal migrants in his city policies and has reportedly allocated over $639.6 million in tax funds towards assistance for illegal migrants since taking office three years ago. However, research from the Center for Immigration Studies indicates that migrants utilize welfare at significantly higher rates than American citizens.

A recent study revealed that from 2021 to 2025, around 47 percent of households headed by immigrants in the U.S. relied on one or more traditional welfare programs. In contrast, this statistic stands at 28 percent for households led by American citizens, highlighting a notable disparities in welfare usage between the two groups.
