The House Judiciary Committee intends to file a lawsuit to compel Attorney General Merrick Garland to turn over audio recordings of meetings between President Joe Biden and special counsel Robert Hur, according to Chairman Mike Johnson.

The lawsuit marks the latest attempt to obtain the sought-after tapes, as the Justice Department has informed Congress that it will not pursue criminal charges against Garland despite the House passing a resolution to hold him in contempt.
“We will be filing a lawsuit against the Department of Justice next week to enforce the subpoena, we will be suing in the appropriate place, the District Court in Washington, and we will be fighting vigorously to enforce the subpoena,” Sen. Johnson, R-Louisiana, told reporters on Wednesday.
Republicans argue that listening to the tapes will shed more context on the special counsel’s comments about the president’s aging and memory, even though lawmakers already have records of Biden’s conversations with Hoare.
Trump has said in the past that Biden’s age itself is not his main concern when it comes to the current president’s ability to run the country, but rather Biden’s declining memory and overall cognitive ability.
Rep. Anna Paulina Luna (R-Fla.) also promised to push for a vote on a resolution that would give House moderators the power to detain Garland, “a process authorized by such an ‘intrinsic contempt’ resolution.” The Hill report.
But Johnson remained equivocal about Luna’s motion, saying his proposal was one of many being considered “in the meantime” and “I don’t think anything has been decided at this point.”
Luna argued that the measures were necessary to comply with the subpoena.
“This process demonstrates how seriously Congress takes non-compliance and what consequences can be faced for those who refuse to cooperate,” she said in a letter to colleagues.
