New Trends in Visa Applications Among Content Creators

Once upon a time, it was mainly international music stars and actors who came to the U.S. for professional opportunities. But these days, a different group is emerging: OnlyFans stars, TikTok influencers, and various content creators are now turning to O-1 visas to work in the United States.

The U.S. Citizenship and Immigration Services (USCIS) describes this visa as intended for individuals demonstrating “extraordinary ability” in fields like science, arts, business, or athletics, or those with remarkable achievements in the film or television industries. It’s quite an extensive definition, isn’t it?

According to USCIS, applicants must be sponsored by a U.S. employer, U.S. agent, or even a foreign employer via a U.S. agent. It’s not a simple self-application process.

“O-1B visas are increasingly seen among influencers and content creators,” noted Raymond Lahoud, an immigration attorney based in Pennsylvania. He pointed out that some applicants are quite prominent, boasting millions of followers and earning substantial incomes.

He added, somewhat casually, “If, say, the most well-known OnlyFans star meets the criteria for an O-1B, who am I to judge? The visa exists for this purpose.” It’s interesting how this new wave of applicants is changing the landscape, isn’t it?

During the pandemic, both movies were being shot and influencers were generating content as people found entertainment at home. Lahoud observed a specific uptick in creators seeking these visa applications, which signifies a recent shift.

A spokesperson from the State Department informed that around 20,000 O-1 visas are issued each fiscal year, maintaining a steady rate for 2024 and 2025. This number is consistent, which is, I suppose, a positive note in terms of predictability.

USCIS aims to determine if applicants are suitable for an O-1 visa, emphasizing that individuals must come to the U.S. temporarily for work in a field where they show extraordinary ability. It’s quite a detailed evaluation process.

Interestingly, Lahoud mentioned that the review process is somewhat systematic. If candidates meet the basic requirements, they could receive approvals in just a few days. There’s an efficiency in that flowchart method, perhaps, that seems to make sense in today’s fast-paced world.

On a curious note, although OnlyFans stars can have vast followings, Lahoud highlighted a contrasting reality for, say, a scientist with numerous publications who may struggle for readership. It’s a stark difference between the visibility of different professions.

Ultimately, he stated that being an influencer parallels being a writer or any other vocation, suggesting that when it comes down to it, “acting is acting.” Yet he also pointed out a unique concern: “OnlyFans movies spread around the world faster than any DVD or Netflix special.” It’s a sign of our times, really.
