Marchan finished addressing the jury before lunch. The jury will continue deliberating until they reach a verdict. They are scheduled to adjourn from 4:30 pm on Wednesday until Thursday.
According to CNN, the jury instructions were: include:
- Decisions should not be based on prejudices or stereotypes.
- They must put aside their personal differences.
- Don’t speculate on how long the sentence will be or what the punishment will be – that’s up to the judge.
- They can’t blame Trump for not testifying.
- “People have to prove every element of the crime beyond a reasonable doubt,” he said, reminding jurors not to base their verdicts on speculation.
- Consideration may be given to whether the witness is hoping to obtain some benefit in relation to the trial or whether he or she has an interest in the outcome of the case.
- Because Michael Cohen is an accomplice, his testimony alone cannot be used to incriminate Trump, but his testimony can be used if corroborated with other evidence.
- Jurors must be unanimous to find Trump guilty on each charge of whether he personally committed a crime, conspired with others to commit a crime, or both.
- They must determine whether Trump conspired to illegally promote or prevent someone from holding public office.
- They should deliberate with a view to reaching agreement, without abandoning personal judgment.
- Juror notes cannot be used in place of evidence.
- After deliberations are completed, the judge will issue a sentence on each charge.
- They must turn in their cell phones and can only discuss the incident when all 12 are together.
