New York judge dismisses lawsuit over luxury $6.2 million property linked to 'harmful UV treatment'

Actress Loses Legal Battle Over UV Protection Claims

A Manhattan actress, who previously survived skin cancer, recently faced a setback in her lawsuit against the developer of her apartment. She claimed that the developer’s assertions about UV protection in her home exposed her to harmful rays, which, she argued, caused her to develop a lesion on her face.

Jennifer Bettite Yen, 48, filed a $1 million lawsuit after alleging that the floor-to-ceiling windows in her apartment did not provide the promised protection. However, the judge dismissed the case, stating her claims were unfounded. The estate, valued at around $6.2 million, was a significant investment for Yen and her husband, film producer J. Payton Wally, 47.

Despite the couple’s concerns, building management and Solovieviv Building Co. communicated with them throughout the process. Interestingly, they had signed a purchase agreement that specified they wouldn’t depend on any promotional materials or representations made regarding the property’s characteristics.

Yen’s legal representatives argued that the dismissal on June 27, which they described as “biased,” prevents her from reviving her claims in the future.

“We are truly appreciative that the judge recognized the situation for what it is,” they stated.

The actress, known for her roles in “Royal Pains” and her hosting duties on “Film Lab Presents,” expressed her worries about the potential dangers of UV exposure in her apartment. Reflecting on her experience, she shared in a blog post about feeling trapped in a “surreal situation” where she feared for her health while believing she was safe.

Efforts to reach Yen and Wally’s legal team for further comments went unanswered.

According to court documents, the couple purchased a stylish 2,984-square-foot, four-bedroom home back in November 2021.
