Republicans Call for Removal of North Carolina Judge
Republicans in the North Carolina Legislature are pushing to remove a judge involved in a controversial case regarding a man accused of stabbing a Ukrainian refugee on a train in Charlotte. The entire GOP delegation from the House has signed a letter urging formal action against Magistrate Judge Teresa Stokes.
This plea comes after her decision earlier this year to release DeCarlos Brown, who is charged with the stabbing of 23-year-old Iryna Zarutska, on the grounds of his “written promise” to attend future court dates.
Brown currently faces charges relating to the incident that occurred in 2022, when Zarutska fled Ukraine due to the Russian invasion. Critics argue that Judge Stokes disregarded Brown’s extensive criminal history, which includes at least 14 prior arrests for serious offenses, when she allowed him to be released without bail.
The GOP members claimed that the judge’s actions could undermine public trust in the judicial system. They noted that Brown has a troubling past, including charges for firearm possession and robbery.
Interestingly, Brown has been diagnosed with schizophrenia and was arrested for a misdemeanor in January after making a call to 911, during which he claimed to be controlled by “artificial” influences.
This incident adds to ongoing concerns among Republicans regarding the handling of crime in urban areas, including those involving public transportation. Recently, there has been a notable pushback from GOP lawmakers who contend that judicial leniency is contributing to rising crime rates.
An attacking issue has been whether the current justice system adequately protects the community. Following Zarutska’s unexpected death, some Republican leaders express that the reforms initiated under the previous administration around public safety haven’t been effective enough in addressing issues like this.
“This tragedy shines a light on the failings of our justice system,” one delegate mentioned, emphasizing the need for a re-evaluation of how judges like Stokes make bail decisions. The allegations surrounding her ruling have sparked broader discussions about judicial accountability in the state.
Stokes’s decision, they argue, needs to be scrutinized as it poses potential risks to community safety. A call for substantial reviews of past bond decisions is included in the letter sent by the House Republicans.
The North Carolina Judicial Branch has not yet responded to requests for comment on the matter. As the situation develops, it highlights the ongoing tensions surrounding crime and judicial responsibility in the state.
