North Dakota Supreme Court Reinstates Abortion Ban
The North Dakota Supreme Court has reversed a previous ruling that deemed the state’s abortion ban unconstitutional, effectively reinstating the ban.
Under the new ruling, performing an abortion is categorized as a felony, which could result in up to five years in prison and a fine of $10,000 for abortion providers. However, patients seeking abortions will not face legal repercussions.
This legislative shift follows North Dakota’s decision to outlaw abortion after the Supreme Court’s Dobbs ruling, which overturned Roe v. Wade. Consequently, Red River Women’s Clinic, the sole abortion provider in the state, relocated from Fargo to Moorhead, Minnesota.
In 2023, the state passed a near-total abortion ban, but it was later invalidated by State District Judge Bruce Romanick, who deemed the law unconstitutionally vague.
According to the North Dakota Constitution, a minimum of four justices must agree to label a law unconstitutional. Three justices expressed concerns about the law’s vagueness, while two disagreed, arguing it is not unconstitutional.
Justice Jerod Tufte stated in his opinion that the natural rights afforded by the state constitution do not extend to abortion. He also mentioned that the law provides “adequate and fair warning” to those attempting to comply.
Opponents of the ruling described it as “a devastating loss for pregnant North Dakotans.” Meetra Mehdizadeh, a senior attorney at the Center for Reproductive Rights, emphasized the confusing nature of the ban, which complicates the ability of doctors to provide care without facing criminal charges. She argued that abortion is a form of healthcare, and North Dakotans should access it without confusion.
On the other hand, Republicans celebrated the court’s decision. North Dakota Attorney General Drew Wrigley remarked that the Supreme Court’s backing of this pro-life legislation is a victory for the people’s Legislature.
State Senator Janne Myrdal, who sponsored the 2023 abortion ban, expressed her gratitude that two highly regarded justices recognized the law’s constitutionality for both mothers and unborn children.
Students for Life of America called the ruling a victory, confirming that North Dakota’s pro-life law is back in effect, making abortion illegal once again.
