On October 11, 2024, U.S. District Judge John L. Sinatra Jr. ruled that New York's ban on concealed carry on private property open to the public is unconstitutional.
The case is christian vs james The plaintiffs are the Firearms Policy Coalition, the Second Amendment Foundation, and private citizen Brett Christian.
Sinatra said New York state law makes it a “felony for a concealed carry license holder to possess a firearm on any private property unless the relevant property owner actually authorizes such possession.” he pointed out.
Then he pointed to Heller (2008), mcdonalds (2010), and blue en (2022), who pointed to the lack of certainty in the Second Amendment right to keep and bear arms and the lack of historical precedent in New York state law in American history.
Sinatra said, “The historical traditions of this nation do not tolerate such a restriction on the right to keep and bear arms. In fact, the right to self-defense was extended to the vast private lands that were open to the public throughout New York State at the time. It is equally important and equally recognized.
He then permanently banned state employees from owning private property.
Alan Gottlieb, founder of the Second Amendment Foundation, reacted to Sinatra's ruling. “Once again, anti-gun advocates in the Empire State were restrained by judges who understand that the Second Amendment is not a second-class right,” he said. “The state sought to perpetuate the de facto ban on lawful carry by banning firearms on all private property open to the public for any reason, but the judge ruled He correctly stated that this restriction would not pass constitutional debate.
