In a recent press release, the Attorney General's Office Said The suspect is charged with murder, attempted murder, aggravated assault of a child, endangering the welfare of a child, and additional charges of “acts leading to the death of a months-old infant and other acts of abuse.” He has been indicted.

The medical examiner determined that the child's death was the result of lethal levels of acetone in his blood at the time of death and ruled it a homicide. Investigators learned that the infant had ingested numerous “water beads” along with button batteries and metal screws in the months before her death. The TribLive.com report continues, “According to the criminal complaint, first responders were called to Owens' home on Electric Street in New Castle shortly after 4 p.m. on June 25 for an unresponsive 1-year-old child. ” he said. The child was reportedly breathing, but his eyes were staring.

However, Court of Common Pleas Judge David H. Acker could not limit the amount of time Jacoby could have custody of the baby, TribLive.com reported.
