Trump Administration Cuts Justice Department Program for Undocumented Immigrants

The Trump administration significantly reduced a Justice Department program that has been crucial for numerous undocumented immigrants trying to counter the department’s own deportation efforts.

Daniel DeWinter, the legal director of the Illinois Immigration Advocacy Project, expressed concern, noting, “It would create serious problems within our immigration system.” His organization has relied on these Justice Department initiatives to seek information and approval while dealing with 948 cases involving federal deportation attempts against immigrants.

In a recent move against illegal immigration, the Justice Department effectively dismantled the Certification Program, which originated in 1983. Part of the Office of Immigration Review—established in the 1950s—the program aimed to direct federal funding to various nonprofit organizations, like Catholic Charities and Jewish Family Services, ensuring that low-income immigrants received qualified legal assistance. It provided training and certification for immigrant rights activists, enabling them to represent individuals in immigration court.

This month, however, the senior attorney in charge of the program was reassigned, effectively discontinuing it. CBS News reported that this transfer disrupted the program’s functioning, as there was no one left qualified to “approve or renew” the needed certifications.

The Justice Department claims that the program is not technically repealed since it is “established by regulation.” Still, with the reassignment, they’ve essentially been unable to execute their responsibilities.

For many years, this office has had a broad influence, assisting countless undocumented immigrants in obtaining legal status annually. Funded by taxpayer money, the program has helped individuals navigate the complex system, granting legal status even for those who entered unlawfully.

As of 2023, the office had notably expanded the number of authorized representatives working with undocumented individuals. These certified agents provided support in various aspects, including contesting admissions denials and avoiding deportation.

In fact, the program was substantial, encompassing over 850 nonprofit organizations dedicated to immigrant rights.

A 2023 report mentioned that while most recognized organizations by the Department of Justice focus on immigration law services, many do not primarily identify as such. According to Villanova University publications, the titled report, “The Unrepresented Migrant Crisis: Significantly Increasing the Number of Certified Representatives Offers the Best Hope for Solving the Problem,” provided insights into this issue.

It highlighted that the roster of roughly 850 accredited organizations includes a variety of entities, from public libraries to domestic violence shelters, workforce programs, and even faith-based charities and student groups.

Between 2010 and 2020, certified non-lawyer representatives assisted in deportation cases for 7,779 immigrants, as stated in the Villanova report.

In Illinois, activists reported assisting around 948 individuals in central and southern areas. This information came from a local source indicating ongoing concerns.

DeWinter raised alarms that the elimination of the program, supported by philanthropic efforts from figures like Jeff Bezos’ ex-wife and others, could hinder his organization’s new application for recognition.

“It’s already a very complex process, and we’re going to see more people facing it without the necessary knowledge,” he commented.

He emphasized that programs like the R&A and others that fund legal services are crucial for helping individuals secure documentation and maintain stability in the U.S. based on the legal relief they can seek.
