Rep. Adam Schiff (D-Calif.) suggested in 2018 that pardoning the president's son could be obstruction of justice.
Schiff's comments are significant after President Joe Biden pardoned Hunter Biden for tax and gun violations. The pardon also covers criminal charges that were not prosecuted by the Justice Department.
Many legal experts believe Hunter may have committed at least a violation of the Foreign Agent Registration Act (FARA). Republicans also claim Joe Biden profited from the deal.
“Congress needs to know whether the president is using the pardon power to obstruct justice,” Schiff said. “The American people have a right to know.”
Schiff's statement was broadcast on CNN in connection with the proposed bill. The proposal was aimed at then-President Donald Trump and his family.
“What exactly does it do?” asked CNN's Don Lemon.
Schiff explained the intent of the bill:
That means that if the president pardons someone in an investigation where the president is a witness, subject, or target, all those investigative files will be turned over to Congress. Congress needs to know whether the president is using the pardon power to obstruct justice. The American people have a right to know. I think it's clearly constitutional. The law does not prohibit the president from granting pardons, or even from granting pardons that should not be given, but it does at least allow the president to know whether he is using this power to evade responsibility. .
