Texas Attorney General Steps In on Surrogacy Case

Texas Attorney General Ken Paxton has taken action in a high-profile case involving a couple in California who are urging their surrogate mother to terminate her pregnancy after discovering the child has a heart defect. This situation has stirred significant debate among pro-choice and pro-life advocates.

The case, sometimes referred to as the “Baby Gabriel” scenario, has created a divide as the surrogate traveled to Texas to seek essential medical care for the child.

Paxton stated, “Gabriel deserves a chance to live, and I will not allow anyone to unlawfully deny him medically essential care.” The fetus is diagnosed with a serious but treatable heart condition, and the intended parents suggested relocating the baby from Texas to avoid necessary surgeries.

On Tuesday, Paxton released a statement indicating he had officially informed both the University of Texas Southwestern Medical Center and the Children’s Medical Center in Dallas of their responsibility to provide the infant with “emergency medical care” immediately after birth. He also requested a court order to stop any move of the infant from Texas.

The surrogate, identified as McKenna West—a nurse and single mother of two from Alaska—spoke about the situation, emphasizing that every life has value. “No woman, including myself, should be forced to end the life of an unborn baby,” she noted, insisting that “Baby Gabriel deserves a chance to live.”

When the biological parents learned of the diagnosis, they attempted to exercise a clause in their agreement permitting “abortion on demand.” In response, they asked West to travel to Seattle for the procedure, but she declined. Instead, she sought to relieve them of financial responsibility for the infant, which they resisted, even suing for $250,000—a move West fears could financially ruin her.

The intent of West’s actions has been questioned in court documents, where the couple asserts that she refused to take an amniocentesis test, hinting at ulterior motives.

Meanwhile, Paxton’s involvement in this emotionally charged case aligns with his pro-life stance, particularly as he is currently campaigning in a U.S. Senate race that could tilt Congressional power. His opponent, James Talarico, represents the Democratic side, which is known for its strong advocacy for abortion rights.
