Republicans ‘Absolutely’ Advocating to Challenge Biden’s Executive Privilege

Rep. Kelly Armstrong (R-North Dakota), a member of the House Judiciary Committee, said Republicans will block President Joe Biden from using executive privilege to release audio recordings of his interview with Special Counsel Robert Hur. He said he “absolutely” disagrees with that.Appeared in Breitbart News Saturday.

Armstrong said the full chamber will consider holding Attorney General Merrick Garland in contempt, but the question is whether Congress can run out the time before the presidential election. Asked whether there was any legal objection to Biden using executive privilege to hide audio recordings, the congressman replied, “There is actually a precedent that says that presidential privilege is waived when you release information to the media.” “It’s in there,” he explained.

“So I think you and I both agree that there is no valid executive privilege claim here. But regardless, I don’t think that question is really a question that can be answered. The problem is, once he gives it up and releases it to the media, he has given up that privilege. But I mean, whatever happens with the time clock, you and I. We also know that…the court system doesn’t move that quickly…The only people who think the court system should care about Election Day are the Democrats, but no matter what happens, if we I think it’s really important to maintain that and move this issue forward,” he said, explaining that it’s “very impactful and important…not just for this election.”

In other words, even if Congress doesn’t get the audio before the election, Armstrong believes it’s necessary to keep pushing the issue.

When asked if there would be a challenge in court, Armstrong said: “I know for a fact that my chairman, Jim Jordan, and my member, Kelly Armstrong, will absolutely insist that we… aggressively pursue this in court.” If we have to go, let’s go to court whenever possible. ”
