Republicans challenge Biden's use of autopen for issuing federal clemency orders

House Republicans are pushing for increased scrutiny over the approximately 1,500 commuting orders that President Joe Biden signed towards the end of his presidency, especially in light of reports indicating that an autopen was used for many of these signings.

Jason Smith, the Republican chairman of the Ways & Means Committee, expressed concern in an interview, suggesting that if the autopen was indeed involved in forgiving debts for numerous individuals, questions arise about who made the final decisions, including whether Biden’s son played a role. He stated, “Americans deserve leaders’ accountability.”

Earlier this month, it was reported that autopen signatures were frequently utilized during Biden’s time in office. Biden himself claimed he made all decisions related to those orders, with a process carefully documented by an aide and communicated through emails.

There’s been some pushback too. Rep. Mark Messmer, a Republican from Indiana, suggested that the use of autopen signatures, particularly those signed late at night, warrants closer examination. He noted that some orders were finalized after 10:30 p.m., which deviates from when the President is typically active. Biden had previously mentioned that he wouldn’t schedule events past 8 p.m. due to needing rest.

Rep. Brandon Gill from Texas emphasized the public’s desire for accountability. “What people want is transparency. They want clarity on what has been done in the name of the president,” he said.

Some lawmakers are even contemplating legal challenges to certain pardons, pondering the possibility of rolling back some decisions. “Maybe some aspects of the amnesty can be reversed,” noted Rep. John McGuire from Virginia.

The House Oversight Committee is currently investigating the Biden administration’s use of autopen signatures and whether former White House officials concealed evidence concerning Biden’s cognitive state. The former White House Speaker, Ronald Crane, is expected to testify soon.

Democrats have criticized the investigation as a politically motivated endeavor rather than a legitimate inquiry.

While many Republican lawmakers agree on the need for accountability, there are varying opinions on whether this focus should be on past actions or on future governance. One Republican expressed a wish to strike a balance: “It’s important to understand what happened to prevent future issues, but I also want to look ahead.” Another pointed out that reminders of the previous administration’s actions are also valuable.

It’s worth mentioning that the use of autopens is a common practice and has been employed by many administrations, including that of former President Trump. However, House investigators are delving into whether Biden authorized any significant decisions.

Former President Biden’s office has not responded to requests for commentary.
