Republicans Press AG Garland to Answer for ‘Aggressive’ J6 Prosecutions

Republican lawmakers are pressing Attorney General Merrick Garland to explain his “aggressive prosecution” of what President Donald Trump and others have called “political prisoners.”

Reps. Chip Roy (R-Texas), Andy Biggs (R-Arizona) and Thomas Massie (R-Ky.) sent a letter to Garland late Monday about the Department of Justice’s (DOJ) “aggressive prosecution of American citizens who were at the United States Capitol on January 6, 2021.” They noted that the prosecution has been described as “the largest criminal investigation in American history.”

Their letter, obtained by Breitbart News, was submitted before Garland. Give Witness On Tuesday, the House Judiciary Committee will hold a highly anticipated Department of Justice oversight hearing.

Garland, the nation’s highest-ranking law enforcement figure, has repeatedly rejected surveillance requests from Roy, Biggs and Massie, but the timely letter upgrading their requests sends a clear signal about the direction of questioning Garland can expect on Tuesday.

Their letter noted that while many of the 1,200 indictments related to Jan. 6 are “meritorious and appropriate,” many of those rounded up in the roundup “either committed no crimes or have been overcharged.” The three Republican senators are using their constitutional oversight powers to pressure the Justice Department to provide a detailed breakdown of those who have been charged.

They write:

To facilitate oversight, we ask the Ministry to provide a detailed and comprehensive breakdown of names, beyond the publicly available information.[s] For those individuals indicted, whether they were charged with a violent or nonviolent crime, the specific charges against them, the crimes to which they ultimately pleaded guilty, and the sentencing requests and sentences they received, and how they compare to non-January 6 defendants who pleaded guilty to the same criminal offenses.

Roy, Biggs and Massey detailed their multiple requests for information and clarification on the matter, which were largely ignored. They wrote that the oversight request “came at a critical time when other reports had surfaced of possible mistreatment of defendants in federal custody, including retaliation by prison officials, confinement in unsanitary holding cells, poor quality food, and degrading individual punishment.”

Importantly, the three men’s letter emphasizes that “other investigations indicate possible FBI involvement in facilitating the events of January 6th.”

Each of the three Republicans chairs a subcommittee on the Judiciary Committee: Roy chairs the Subcommittee on the Constitution and Limited Government, Biggs chairs the Subcommittee on Crime and Federal Oversight, and Massie chairs the Subcommittee on Administrative State, Regulatory Reform, and Antitrust.
