San Francisco sued over guaranteed-income programs blasted by critics as racist

Two conservative groups say San Francisco and the state of California are racists for illegally donating millions of tax dollars to three nonprofits that exclude recipients based on race and gender identity. It is claimed that

The American Civil Rights Project and the Californians Equal Rights Foundation allege that the city and state are violating the law by choosing who receives federal funds based on the color of their skin.

The complaint cites three guaranteed income programs.

The Black Economic Equity Movement is distributing $500 a month exclusively to young Black Bay Area residents.

The Transgender Income Guarantee program pays recipients $1,200 a month if they are Black, Indigenous, or Latino and transgender.

The Abundant Birth Project provides $1,000 a month only to pregnant Black and Pacific Islander women.

“We’re calling for these programs to end until they no longer discriminate,” said Dan Morenoff, an attorney with the American Civil Rights Project.

“Each of these three programs determines an individual’s eligibility, disqualification, and benefits based on race.”

In 2020, the City of San Francisco established the Prosperous Birth Project through its Department of Health. Limited to “Black and Pacific Islander women residing in San Francisco,” the grant will provide between $1,000 and $1,500 a month for approximately nine months. Other races are not eligible for this “unconditional” income. The annual budget is $1.8 million, but he added a new $5 million grant and expanded the program to four more counties.

Advocates say Black and Pacific Islander women need help because they have higher rates of premature birth. Dr. Zea Marawa of the San Francisco Department of Public Health said, “This risk is primarily due to racism, structural racism and the racism that people who give birth experience in their interactions with doctors and other health care providers. This is due to both.”

True or not, the lawsuit claims it is still illegal to exclude white and Latinx women, especially those at higher risk for complications.

Last November, the city of San Francisco launched another guaranteed income program.

According to BEEM’s guidelines, “to participate, you must be Black, between the ages of 18 and 24, and live in certain areas of Oakland or San Francisco.” People who apply online as “white” are told they are “not eligible.”

The GIFT project will provide $1,200 per month for 18 months to “transgender, nonbinary, gender nonconforming, and intersex” people, provided they are “Black, Indigenous, or people of color.” The program is administered through the city’s Office of Transgender Initiatives. Last week, the watchdog group Judicial Watch also sued San Francisco over the GIFT project.

Money for all three programs is provided unconditionally through a debit card that is refilled monthly.

“A guaranteed income is a one-time monthly payment paid to people without any requirements or obligations,” says BEEM. “This is an approach to support people, giving them a bit of breathing room, allowing them to address their immediate needs and plan for the future.”

Similarly, the GIFT project “will provide participants with a $1,200 stipend so they can focus on their basic physical and mental health and wellness without worrying about income.” states.

FOX News contacted all three programs, but all declined to be interviewed. Mayor London Breed’s office said in a statement that the program is legal and looks forward to addressing the charges in court.
