Trump Administration Investigates New Hampshire School District
The Trump administration has initiated an investigation into a New Hampshire school district following a complaint that claims the district’s policies are discriminatory against biological girls. This complaint was brought forth by the parental rights group Defending Education in August 2025.
According to the complaint, the Contoocook Valley School District’s policy permits access to facilities like bathrooms and locker rooms based on “gender identity” instead of biological sex. The complaint highlights that the district’s non-discrimination policy notably lacks references to discrimination based on sex.
The Department of Education announced the investigation in a statement on Tuesday. Kimberly Richey, the assistant secretary for civil rights, expressed concern, stating, “Young women should never feel unsafe or uncomfortable in their intimate spaces because their school leaders care more about gender ideology than protecting girls’ dignity and privacy.” She criticized the expectation for girls to vacate their spaces if a male is present, describing this as absurd and discriminatory. The administration committed to investigating such complaints and enforce Title IX to ensure the safety of women and girls in schools.
Reports have surfaced that district officials have told girls they would need to find alternative spaces if they feel uneasy about boys being in their areas. This information comes from the Defending Education group.
Previously, the Daily Caller News Foundation reported on Contoocook and other school districts in New Hampshire for policies that require students and staff to use preferred pronouns for students who communicate transition plans, sometimes without notifying parents.
Sarah Parshall Perry, a vice president at Defending Education, commented on the situation, noting that some states are delaying compliance with civil rights laws as per their language and history. She pointed out that the Contoocook Valley School District is among those receiving federal funding that is now in conflict with the Department of Education. Perry emphasized that the district’s adherence to opposing state anti-discrimination laws regarding gender identity, which contradicts federal guidelines for sex equality in education under Title IX, has drawn federal attention. She expressed satisfaction that they will now have to answer for their apparent disregard for the Supremacy Clause of the Constitution.
