Scott Peterson’s lawyer filed the petition on Monday, but says it contains evidence that he did not kill the unborn baby and his wife in 2002.
The Los Angeles Innocence Project, which took over Peterson’s lawsuit, filed a habeas-protection warrant on Monday. This claims in a press release the group contains “substantial new evidence.” Peterson’s lawyers claimed that at a 2004 trial, he petitioned Peterson’s right to justice and his right to justice, claiming that his conviction should be overturned.
“This… habeas and guardians present new evidence that was not available at trial, supporting the petitioner’s claim of innocence, indicating that he was falsely convicted,” the petition filed Monday. “This new evidence undermines the overall case of the prosecutor against the petitioner, indicating that the ju-gager relied on false evidence, including false scientific evidence, to convict him.”
Peterson’s attorney argued that the case against him was “completely circumstantial,” adding that “direct, physical or forensic evidence supports some of the prosecution’s theory, or otherwise imply a petitioner.”

Peterson was found guilty of murdering his wife Rashi in 2004 and guilty of the second-degree murder of the couple’s unborn baby, Connor, the death of the couple. Rashi Peterson disappeared from his home in Modesto, California on Christmas Eve in late 2002. Pedestrians discovered the body of a fetus that had been decomposed at the time in the San Francisco Bay in April 2003.
In a filing Monday, the lawyer argued that the ju judges did not hear any evidence that appears to have influenced the outcome of the trial, and accused the prosecutor of potentially destroying the evidence.

“Every aspect of the prosecutor’s theory regarding how the crimes in this case were committed now has been shown to be false,” the petition states. “The new evidence in this revised petition indicates that the prosecution’s overall theory of the case was incorrect… In some cases, if there are many unconstitutional or statutory violations, the court concludes that the error is low in cumulative or cumulative, cumulative, cumulative, cumulative, cumulative, cumulative, cumulative, cumulative, cumulative, cumulative, cumulative, innocence of the petitioner.”

The Los Angeles Innocence Project featured the Peterson incident in January. The group’s mission is to protect individuals who believe they have been wrongly convicted.
