Congressional Republicans Aim to Close Deportation Loopholes for DUI Offenders

Republicans in Congress are working to address loopholes that currently allow illegal immigrants convicted of DUI to avoid automatic deportation. Senator Bill Hagerty from Tennessee plans to introduce legislation this week aimed at preventing these individuals from entering the U.S. and ensuring that those already here are deported.

The proposed measure, known as the Protecting our Community from DUIs Act, seeks to clarify current laws in the Immigration and Nationality Act, which already permits deportation for illegal immigrants guilty of aggravated felonies and certain moral crimes. However, it’s important to note that not all DUI offenses are equivalent. Some are misdemeanors while others are felonies, yet all can be categorized as crimes involving moral questions.

Hagerty’s legislation would classify DUI convictions as a basis for deportation, regardless of whether they fall under misdemeanor or felony categories. This reflects long-standing concerns from immigration advocates who worry that certain administrations might exploit loopholes or vague legal language to hinder deportations.

The bill clearly states that any foreign national convicted or admitted to violating laws related to driving under the influence or while impaired can face deportation, regardless of how these offenses are classified at any level of government.

Hagerty expressed concerns over a rise in violent crimes perpetrated by illegal immigrants during the Biden administration, asserting that these individuals have not been held accountable for their actions.

He further emphasized the importance of the bill, saying, “Illegal immigrants who break our laws and jeopardize our communities are unacceptable.” The legislation aims to bolster enforcement mechanisms that would hold these individuals accountable.

During his presidency, Joe Biden was known to threaten ICE agents for deporting individuals convicted of low-level offenses, stating that they should focus only on serious felony cases.

In discussions within the House, Representative Tom McClintock highlighted that anyone who endangers Americans by driving under the influence should not be allowed to remain in the country. His remarks echoed a sentiment that resonates across party lines, with some Democrats acknowledging the issue.

Several Senators, including Ted Budd, Katie Britt, and Shelley Moore Capito, have signed onto Hagerty’s legislation, while Representative Barry Moore is working on parallel efforts in the House.
