Senator establishes lasting safeguards against excessive water regulations by Democrats

Ernst Proposes Policy Changes on Clean Water Regulations

In a bid to challenge the Biden administration’s clean water regulations, Senate President Joni Ernst proposed permanent policy exclusions on Thursday. This move follows efforts to roll back the expansion that had sparked anger among farmers and landowners.

With a lighthearted comment, Ernst, an Iowa Republican, remarked on the frustrations of navigating federal water regulations. She likened it to trying to climb a stream without paddles—a sentiment echoed by many in the Heartland who feel burdened by governmental oversight.

Under the current regulations, rainwater pools, runoff from farms, and even small ponds have come under federal jurisdiction, rather than being managed locally. This shift has raised concerns about the livelihoods of farmers and small businesses.

Ernst expressed enthusiasm about working with EPA administrator Lee Zeldin to revise what she described as a harmful regulatory expansion. “The uncertainty surrounding WOTUS regulations has posed long-standing threats to Iowa’s agricultural community,” she stated.

The proposed “Clear Waters Act” aims to provide clarity and consistency in how water regulations are applied. Iowa Agricultural Secretary Mike Naig emphasized the necessity of ending the ups and downs in policy that follow each administration.

In a related context, recent Supreme Court decisions have also impacted environmental regulations, particularly the 2023 Sackett case. The court’s majority opinion limited the Biden administration’s regulatory reach, sparking criticism from Democrats like Senate Minority Leader Chuck Schumer. He expressed concern over the implications for wetlands and water quality in the wake of these rulings.
