Murphy signs the intrusion law
In a significant win for NJEA members, Governor Murphy has enacted law S2078/A1675. This legislation returns many educators to their original pension tier, addressing the issue for those who experienced career breaks of over two years. Affected individuals, especially women who stepped away to care for family, found themselves in a worse position, automatically shifted to a Tier 5 pension upon their return, despite previously earning credits. This shift means they’ll need to work another decade, ultimately seeing a substantial decrease in their retirement benefits.
The NJEA backed this law to rectify the situation, extending the correction period to 10 years. After extensive advocacy, including personal stories shared with New Jersey lawmakers, both bills passed last June. With Murphy’s signature today, the rights of members will be restored to their original pension class.
NJEA leaders, including President Steve Beatty, Vice President Petal Robertson, and Secretary Tina Dare, released a statement highlighting the achievement.
“Today, we celebrate the power of union advocacy and solidarity. Last year, our members dedicated countless hours to reversing unjust laws. We achieved a significant victory.”
“Yet, this is merely a starting point. Even with this important win, many members still remain in Tier 5. This is a much lower pension class, requiring new educators to work significantly longer before retirement, and reducing the number of retirees. Therefore, we are working to strengthen Tier 1 for all members.”
