Six states sue Biden administration over new Title IX protections for trans athletes in girls’ sports

Tennessee Attorney General Jonathan Scumetti announced Tuesday that he is leading six states in suing the Department of Education (ED) for its review of Title IX of the Education Reform Act.

The lawsuit was filed in the U.S. District Court for the Eastern District of Kentucky, according to court documents.

“The U.S. Department of Education does not have the authority to put boys in girls’ locker rooms,” Tennessee Attorney General Scumetti said in a statement.

“In the decades since its enactment, Title IX has been widely understood to protect women’s privacy and safety in private spaces such as locker rooms and bathrooms. And under the illegal effort, if a man enters a woman’s locker room and the woman complains that she was made uncomfortable, she will be subject to investigation and penalties for violating the man’s civil rights. “This is an unconstitutional power grab.”

But the new rules lack a policy that would prohibit schools from enacting outright bans on transgender athletes competing against biological women.

Under the new rules, sex discrimination includes discrimination based on gender identity and sexual orientation. The regulations state that schools cannot differentiate or treat people differently based on their gender except in limited circumstances, and critics say the change will allow locker rooms and restrooms to identify gender identity. LGBTQ+ students who face discrimination are entitled to a response from their school under Title IX, and students who are rejected by their school can seek redress from the federal government.

The Department of Education sent a statement to Fox News Digital saying it “does not comment on pending litigation.”
