Meta’s Legal Settlement and Age Verification Measures

In a recent legal settlement, Meta has committed to enhancing its child safety measures, particularly in age assurance, which is critical for ensuring that users are accurately identified as minors or adults. Without effective age verification, the safeguards lose their value.

Identifying child accounts is also a key component of safety protocols that other tech companies, like Google, TikTok, and Roblox, are adopting as public scrutiny increases regarding their platforms.

The agreement, which involves Meta and 48 states along with the District of Columbia and U.S. territories, includes a significant $18 billion settlement. This follows claims from state attorneys general that Meta’s design choices on Instagram and Facebook have been detrimental to young users’ mental health. The company now has a year to refine its strategies for age verification, although the road ahead is fraught with challenges, especially in terms of privacy concerns for both minors and adults needing to prove they are over 18.

AI’s Role in Age Estimation

In the real world, we often rely on government-issued IDs to verify age for various activities, like entering a bar or purchasing tobacco. This method extends online, but many users are hesitant to provide their identification to large tech firms like Meta or Google.

Meta does accept IDs for age verification, promising to delete them within 30 days. However, many tech companies are leaning towards using artificial intelligence to make age estimations. Yet, it’s important to note that while AI can make educated guesses on age, it doesn’t truly verify a person’s birth date.

For instance, Google introduced an age-assurance system last year for YouTube that uses AI to distinguish between minors and adults based on watch history, a tactic that Meta has mirrored.

AI age assessments involve analyzing various indicators. On Instagram, this means looking at “contextual clues” like birthday posts or school-related content, examining interactions like what posts someone engages with and when they are active online. For example, if a user is offline during school hours, they might be school-aged.

Meta has indicated that its AI also assesses photos for visual indicators—like height or bone structure—to estimate age, though it doesn’t identify the individual in the images.

According to the agreement, Meta will enhance its age-checking technologies, incorporating its tools alongside third-party solutions. Regular audits will ensure the efficacy of these measures, with specific targets set for minimizing false positives, meaning young users incorrectly identified as over 18. If a user under 13 is detected on the platform, Meta will also evaluate the ages of their friends.

Facial Recognition for Age Verification

Some companies specializing in identity verification, such as Yoti and Persona, collaborate with tech firms like Meta and Roblox, using video selfies to estimate users’ ages.

Roblox requires young players to submit a video selfie for age estimation and claims that the videos are deleted shortly after the verification process. Notably, this is not mandatory unless users wish to access chat features.

While some users have experienced inaccuracies in these estimations, experts warn about the reliability of facial recognition tools, especially concerning women and various racial or ethnic groups. However, Roblox’s chief safety officer noted that the system can accurately estimate ages for individuals between approximately 5 and 25, give or take a couple of years.

Some social media platforms, including Meta, argue that app store owners, like Apple and Google, should handle age verification. Their position suggests that age verification should occur before users download apps, a notion that Apple and Google have publicly contested.

Google pointed out that the proposal, deemed “simple” by proponents like Meta, fails to address desktop or shared devices effectively, raising concerns about misuse.

Ongoing Privacy Concerns

Age verification aims to keep children safe from inappropriate online spaces, whether those are social media or adult content. However, critics highlight a troubling trend towards less privacy and freedom on the internet, where users might be barred from accessing not just adult content, but crucial information and platforms.

The definition of what is harmful to minors can vary significantly, and experts warn that laws mandating age verification might infringe on First Amendment rights. This raises a myriad of concerns about requiring age verification for a wide range of online services, from streaming platforms to personal blogs.

The Electronic Frontier Foundation has been cautioning against the implications of “age-gating the internet” for years.

“Regardless of the method, every system requires users to provide sensitive personal information that connects their real-world identity to their online activities,” the EFF remarked. “Once this valuable data is collected, it can easily be compromised.”
