Social Media Companies Face Legal Challenges Over Child Safety

For years, social media firms have pushed back against claims that their platforms adversely affect the mental health of children, arguing that their design choices do not intentionally hook young users or expose them to harmful content. Now, however, these tech giants will defend themselves in courtrooms nationwide, including facing a jury for the first time.

Major players like Meta and TikTok find themselves embroiled in lawsuits from various sources, including school districts, government entities, and countless families, all seeking accountability for the alleged harm to children’s mental health.

Currently, trials are underway in Los Angeles and New Mexico, with more anticipated soon. These legal proceedings mark a critical phase in the ongoing evaluation of child safety concerning social media, focusing on whether intentional design elements contribute to addiction and subsequent issues like depression, eating disorders, or even suicide.

Experts are drawing parallels between these cases and past litigations against the tobacco and opioid industries, expressing hope that social media platforms could face similar consequences as those industries did.

The legal outcomes might pose challenges to the companies’ protections under the First Amendment, as well as Section 230 of the 1996 Communications Decency Act, which currently shields them from liability for user-generated content. The potential costs in legal fees and settlements could be significant, and the companies may have to adjust their operations, risking both user engagement and advertising revenue.

Key Cases in the U.S. Regarding Social Media Harm

The Los Angeles trial focuses on the question of addiction. Jurors are being introduced to what’s expected to be a lengthy and complex case, featuring arguments from both plaintiffs and defendants, including Meta and YouTube.

The case derives its name from a 20-year-old referred to as “KGM.” This individual’s situation could be pivotal in influencing numerous similar lawsuits across the country, as KGM’s case—and two others—has been designated as a bellwether trial meant to test legal arguments before a jury.

Matthew Bergman, representing more than 1,000 plaintiffs at the Social Media Victims Law Center, called this moment a crucial turning point. “When we set this process in motion four years ago, no one believed we’d reach trial. But here we are, presenting our case to an impartial jury,” he noted.

Mark Zuckerberg, Meta’s CEO, testified on Wednesday, primarily reiterating familiar talking points. He found himself discussing age verification, asserting the company’s policy restricts users under 13 and emphasizing efforts to identify users who may lie about their ages to bypass such restrictions.

When asked whether addiction leads to increased usage, Zuckerberg seemed uncertain. “I’m not sure what to say to that,” he replied. “I don’t think that applies here.”

New Mexico’s Case Against Meta

In New Mexico, Attorney General Raúl Torrez has taken action against Meta, having launched a lawsuit in 2023. His team posed as children online, documenting inappropriate solicitations and Meta’s subsequent responses.

Torrez is advocating for better age verification processes and enhanced actions to eliminate harmful users from the platform. He has also criticized algorithms that might present dangerous material and raised issues regarding end-to-end encryption, which can hinder the monitoring of communications containing children for safety purposes. While Meta defends encryption as a necessary privacy tool, the state argues for greater precaution.

The trial began in early February, with prosecuting attorney Donald Migliori claims that Meta has misrepresented its platforms’ safety features, choosing to prioritize user engagement over youth safety. “Meta has clearly prioritized growth over children’s safety,” Migliori stated in court.

In contrast, Meta’s attorney Kevin Huff countered this by outlining the company’s various initiatives aimed at filtering harmful content, while also cautioning that some damaging material inevitably slips through.

School Districts Challenge Social Media Firms

Another trial slated for summer will see several school districts taking social media companies to court in Oakland, California. This multidistrict litigation features six public school districts as key players.

Jayne Conroy, a participant in the trial team, noted that both cases focus on the theme of addiction, particularly regarding children and their vulnerable developing brains. Conroy’s experience includes previous litigation against pharmaceutical companies linked to the opioid crisis, leading her to find that the underlying medical principles are surprisingly similar, revolving around dopamine responses.

Both the social media and opioid-related lawsuits claim negligence on the part of the companies involved. Conroy pointed out that, just as with opioids, these companies appear aware of the potential dangers yet have prioritized profits and user engagement over safety concerns.

Long Road Ahead

Social media companies continue to argue that their platforms are not addictive. During the Los Angeles trial, Zuckerberg reaffirmed previous statements, suggesting that current scientific evidence does not adequately support claims linking social media usage to mental health issues.

However, the debate continues to intensify among researchers, parents, and educators concerned about the impact of social media on children’s well-being. Some analysts have observed that while Meta has rolled out new safety features, there remains a focus on attracting young users, often neglecting to follow its own safety guidelines.

The resolution of these legal disputes could take years, particularly given the likelihood of appeals and negotiations. In the U.S., regulatory progress is notably slow compared to that in Europe and Australia.

“There’s a growing sentiment among parents and educators for lawmakers to take stronger action,” said analyst Minda Smiley. “While both state and federal initiatives are gaining traction, heavy lobbying from tech companies and ongoing disagreements among lawmakers about the best way to regulate social media are hindering decisive reform.”
