The Supreme Court is hearing Donald Trump’s request for immunity for final arguments for his 2023-2024 term.
The Supreme Court is scheduled to hear arguments Thursday seeking historic impunity for former President Donald Trump, in the final arguments scheduled for the 2023-2024 term. The question before the justices is whether Trump can be tried criminally for conspiring to overturn the 2020 election results. The court’s response will determine whether Trump’s trial in Washington, D.C., by U.S. District Judge Tanya Chutkan, originally scheduled for March 4 but currently on hold, can proceed, as well as whether Trump’s trial in Florida and Georgia can proceed. It will also decide whether the trial of the former president can proceed.

President Trump asked for the charges to be dropped, arguing that he was immune from prosecution because he was president. After Chutkan denied that request in December, Smith came to the Supreme Court and ordered Trump’s immunity without waiting for the U.S. Court of Appeals for the District of Columbia Circuit to rule on Trump’s appeal. He asked the judges to consider the allegations. Judges denied that request on December 22nd.
Six weeks later, the D.C. Circuit upheld Chutkan’s decision, rejecting President Trump’s immunity claim. He told President Trump that if he did not ask the Supreme Court to intervene by then, the decision would take effect on February 12 (so the criminal case against him could proceed).
This means that Mr. Trump has gone to the Supreme Court and asked that the D.C. Circuit’s decision be put on hold so he can file a petition to review it. Mr. Smith stressed the importance of “thoughtful consideration,” but Mr. Smith countered that Mr. Trump’s trial should proceed without further delay.

If presidents are not granted immunity, all outgoing presidents will be subject to immediate prosecution by their opponents. Without complete immunity, the President of the United States cannot properly carry out his duties.
If a president lacks immunity, the opposition can blackmail him during his term by saying, “If you don’t give us everything we want, we’ll prosecute you for what you did.” Even if everything that was done was completely legal and proper. It’s the end of the presidency and our country as we know it, and it’s just one of the many traps a president without executive privilege can fall into. Obama, Bush, and eventually crooked Joe Biden will all be in big trouble. If the president is not immune, he will simply be a “ceremonial” president with little courage to do what needs to be done for our country. This is not what the founders had in mind. Without executive privilege, the president loses his power and prestige, and under some leaders no power at all. The office of president will be occupied by another branch of government. That’s not what our founders wanted!
If they strip me of my presidential privileges, they’re stripping crooked Joe Biden of his presidential privileges.
Without executive privilege, it would be impossible for the president to properly carry out his duties, putting the United States at grave and permanent risk.
