A convicted rapist is facing serious charges after allegedly assaulting a woman near Randall’s Island. Prosecutors say Miguel Giro was captured on surveillance camera wearing wet jeans and boots shortly after the attack on Diana Agudero.
Giro, who is being held without bail, is accused of brutally attacking the 44-year-old Agudero while she was riding her e-bike along a secluded path near East 125th Avenue. He reportedly threw her bike into the Harlem River shortly after the incident.
Fifteen minutes after he was seen disposing of the bike, Giro appeared on another camera near the Help USA Keener Homeless Shelter at 64 Sunken Garden Loop, coming from the direction where he had abandoned the e-bike. A complaint from the NYPD details that he entered the shelter at that time.
The footage shows him in bright jeans that looked wet in the back, paired with a colorful sweater and Timberland boots that also appeared damp.
Interestingly, Giro was required to wear a GPS ankle monitor as a condition of his parole after serving 12 years in prison for a prior rape conviction. That monitor recorded him traveling at speeds up to 16 mph towards the coast. Later, the bike was located by an underwater recovery team.
The following morning, Agudero was discovered between rocks along the shoreline just north of the bridge. Giro’s GPS data also confirmed his presence in that area around the time she was found.
After the attack, Agudero was rushed to Elmhurst Hospital, where she remains in critical condition. Authorities reported multiple brain hemorrhages, skull fractures, and significant injuries to various parts of her body. There’s concern she may not regain consciousness.
Stephanie Rodas, Agudero’s daughter, shared that her mother was scheduled for two surgeries to address severe brain trauma, which could be life-threatening.
Interestingly, Giro initially called 911 to report the attack and was taken to Rikers Island the same night, facing charges of murder.
This repeat offender had a history of violent crime, with a prior prison sentence for rape in 2011, from which he was paroled just last year.
