An Israeli court in Tel Aviv ruled on Sunday that Palestinians seeking refuge in Israel because of their lesbian, gay, bisexual, transgender, queer, or other sexual identities could find their lives at risk under Palestinian rule. The court ruled that he could be granted asylum because of his gender.

The Palestinians who filed the appeal have lived in Israel since 2015 and claim their lives are in danger in the Palestinian territories because of their sexual identity. In the appeal, the Palestinian describes how he was forced to come out to his parents after he refused to marry a woman of their choice, and how his father responded by attacking him and telling additional relatives. He also mentioned how he called for attacks.

Realizing that his life was in danger, the Palestinian fled his home and entered Israel. After hiding in Israel for some time, the Palestinian approached authorities through an organization that helps LGBTQ+ Arabs apply for residence permits. The application was initially refused, but after further procedures he received a temporary permit.
One reason the issue is legally ambiguous is that the United Nations Relief and Works Agency (UNRWA), currently in trouble following revelations that more than a dozen of its staff members took part in the October 1 Hamas terrorist attack, ) is considered to be outside the scope of the United Nations Refugee Convention, which the Israeli court applied in this case.
Interior Minister Moshe Alber, an ultra-Orthodox rabbi, is appealing the ruling for reasons that were not immediately clear. Abel is considered one of the more “progressive” members of a religious community that generally rejects homosexuality. The legal status of Palestinian “refugees” is a thorny political issue that Israel may not want resolved in domestic courts.
Either way, the fact remains that Israel is the only safe place in the Middle East where openly LGBTQ+ people can live as they wish.
Many critics have commented on the “Queer for Palestine” phenomenon, in which Western LGBTQ+ groups march in support of a national movement that denies their existence. Alan Dershowitz, professor emeritus at Harvard Law School, told Newsmax in October. “The best evidence that this is all anti-Semitism is that the groups they support hate and hang gays, hate transgender people, hate women, and treat them third class. That’s what the people are saying. Nevertheless, these protesters are willing to overlook these core issues as long as they also hate Jews and the Jewish nation-state.this is nazism [2023]”
