Dawn Buckingham, director of the General Land Office, said the Biden administration’s policy to block new exports of liquid natural gas is stealing money from Texas schoolchildren and hindering America’s energy independence.
“Biden has declared war on Texas and Texas energy,” Dr. Buckingham told Breitbart Texas. “From our wide-open southern border to this move to upend our economy, it’s clear that our country is a target for this administration.”

“I support Texas’ fight on the border and will continue to do everything in my power to support state-led border security,” Buckingham told Breitbart. “I also support Texas energy, and as Texas Land Commissioner, I will do everything in my power to protect this vital industry from federal overreach.”
The commissioners said in the complaint that the Texas General Land Office has deposited more than $30 billion into the state’s Permanent School Fund since its creation. During the last fiscal year (September 1, 2022 to August 31, 2023), energy production in Texas generated $339 million in natural gas revenue for the Fund.
“An LNG export ban would harm the state of Texas by hindering billions of dollars in capital investment in natural gas export projects,” the complaint states. It would “hinder Texas’ ability to maximize Permanent School Fund returns” and “result in Texas producers reburning excess natural gas instead of bringing it to market.”
The complaint says this will increase methane emissions and reduce or eliminate important economic benefits such as jobs, infrastructure renewal, and long-term development.
“The oil and gas industry supports more than 2.5 million jobs across the state, many of them good-paying jobs and the backbone of Texas’ rural economy,” Buckingham said in a written statement announcing the lawsuit. Ta. “Furthermore, Texas-led energy security allows us to support our allies in Europe, Asia, and the Middle East in times of conflict by providing cheaper, cleaner-burning LNG as an alternative to Russian or Iranian gas.”
“Given these facts, it is unconscionable for our federal government to take such drastic steps with the goal of shutting down this thriving industry,” the chairman concluded.
The lawsuit filed by Texas and 15 other states in the Western District of Louisiana (Case 2:24-cv-00406) seeks to:
a. Declares that the LNG export ban violates the law, exceeds statutory authority under the APA, or is an ultraviral act.
b. Declares that the LNG export ban is arbitrary and capricious and illegal under the APA.
c. Declaring that the LNG export ban violates the APA because it was promulgated without notice or comment.
d. Declares that the LNG export ban violates 15 USC § 717b(a).
e. Declaring that the LNG export ban violates the Congressional Review Act.
f. Declares that the LNG export ban violates Article 1 of the Constitution.
g. Declares that President Biden’s proclamation is extremely dangerous.
h. Revoke the LNG export ban as illegal.
I. Maintains the LNG export embargo under 5 USC § 705.
j. Preliminarily and permanently enjoining Defendants from considering or attempting to suspend consideration of any LNG export application without bond;
k. Grant all other relief to which Plaintiff State is entitled, including without limitation attorneys’ fees and costs.
