The Harris County Sheriff’s Office said officers pulled over Patrick Hurst, 47, on the 1960 Farm-to-Market Road near Ella Boulevard in Houston.
Hurst led police on a brief chase, but fired shots at police, who returned fire and killed Hurst.
Video of the incident shows him livestreaming on Facebook and on the phone with his sister, Angela Washington.
Livestream video clearly shows him raising his gun before getting out of his car to confront police. Surveillance camera video showed police fanning out and confronting him at the gas station.
“I was on the phone and saw him live,” Washington said.
She said she was trying to stop her brother during the incident. She also said she had no grudge against the police.
By the time Washington arrived on the scene, her brother was already dead.
“I think what we said yesterday was a mental breakdown,” she added.
During the gunfire, a woman who was shopping nearby was struck by a bullet. A private school bus was also hit by gunfire.
His sister remembered telling him, “Stop!” before a deadly interaction with police.
The sheriff said the man claimed he was a sovereign citizen, but Washington denied the claim and said he had not told his family anything about being a sovereign citizen. Sovereign citizens believe that U.S. laws do not apply to them, and many have clashed with law enforcement in their interactions.
She acknowledged that he had faced mental health issues in recent years, but said she did not know he owned a gun until the incident with police.
HCSO said ballistics testing will determine whether the bystander and the school bus were shot by officers or Hearst.
Washington said she would like to remember him when he was happier.
“He was always doing God’s work. He was always doing our father’s work,” Washington recalled. “It’s being honest with God’s truth, so this was a huge shock.
