Senate Republicans Request Investigation into Jack Smith
Senate Republicans are urging the Justice Department to look into former special advisor Jack Smith for possible illegal political actions that may have influenced the 2024 election, particularly against President Donald Trump.
Senator Tom Cotton, who chairs the Senate Intelligence Email Committee, criticized Smith, claiming he represents a partisan agenda within the Biden-led Justice Department. Cotton feels that Smith’s actions, particularly in relation to the 2024 election, lack justification and may violate federal law.
Smith has been involved in investigating the handling of sensitive documents taken from former Attorney General Merrick Garland, especially during Trump’s scrutiny of the Mar-A-Lago properties tied to allegations of trying to overturn the 2020 election results.
Cotton pointed out that the special advisor’s role is to ensure federal employees refrain from partisan political activities while on duty. He argued that Smith’s legal maneuvers appear aimed at swaying the upcoming election, raising concerns about their legality.
He listed several instances during Smith’s tenure, alleging procedural irregularities such as prolonging trial dates and releasing information without legitimate reasons. One point he made was regarding the swift scheduling of jury selection for Smith’s case against Trump, which was related to the August 2023 charges stemming from the 2020 election investigation.
The charges against Trump included conspiracy to defraud the United States and obstructing a federal proceeding, among others. Cotton stated that defendants typically have ample time to prepare for their cases, yet here, jury selection was set only two weeks before the Iowa caucuses.
Additionally, Cotton accused Smith of bypassing the usual appeals process and not clearly communicating the reasons for his decisions. He felt that a quicker trial was sought, as Smith previously requested to hold the trial before Election Day, leading to confusion and rapid legal responses.
Cotton criticized Smith’s adherence to the Department of Justice’s “60-day rules,” revealing that certain actions taken by Smith followed a Supreme Court decision regarding presidential immunity shortly after the election.
He concluded that these actions seem questionable unless Smith’s true aim was not to interfere with the election. Cotton claimed that during Smith’s time in office, he frequently applied “pretentious” legal theories in prosecuting presidential candidates. Ultimately, while Trump may have won against Biden in the election, Cotton emphasized that this doesn’t absolve Smith from potential illegal activity.
