Sen. Tommy Tuberville (R-AL) introduced the law on Wednesday to write one of President Donald Trump's important campaign pledges into the law.
Tuberville and Senator Tim Sheehy (R-MT) have introduced the Elderly Tax Elimination Act to stop unfair double taxes on Social Security benefits.
“As older people work most of their adult lives, they can feel comfortable leaving,” Tuberville said in a statement to Breitbart News ahead of introducing the bill. “At a day and age where the cost of living has skyrocketed, our seniors should not experience a second tax on Social Security if they have already paid income taxes on their pay.”
The Elderly Tax Elimination Act amends the Internal Revenue Act of 1986 to end the inclusion of Tier I Rail Retirement Benefits and Social Security Benefits in individuals' gross income. As Tuberville's laws take effect, the tax liability for seniors will be significantly reduced, and the “double tax” on seniors' federal government-earned benefits will end.

Rep. Thomas Massey (R-KY) introduced fellow laws into the House of Representatives.
“Although seniors have already paid taxes on Social Security contributions via payroll tax, these benefits must be listed as taxable income on their tax returns,” Massey said in a statement. Ta. “This is a way for Congress to earn more money to the federal government at the expense of older people who have already paid Social Security. My bill exempts Social Security retirement benefits from taxation, and millions of people are It will increase retirement income for older Americans.”

“Social Security benefits have not been taxed for the first 50 years,” Carney said. This was strengthened by the Congressional Research Services (CRS), a nonpartisan public policy research institute that serves Congress.
“Before 1984, Social Security benefits were exempt from federal income tax,” says CRS. “The council then enacted laws that taxed some of these benefits, gradually increasing as a person's income rose above a certain income threshold.”
Trump has long been an advocate for protecting Social Security and Medicare, as he told Breitbart News in an exclusive interview at Mar-a-Lago in March 2024.
“I will never endanger or harm Social Security or Medicare,” he told Alex Marlow and Matt Boyle of Breitbart News. “We have to do [find cuts] Other places. But we are not going to do anything to hurt them. ”
Tuberville's bill follows his recent announcement that he will serve on the Senate Committee at the 119th Congress.
“As Alabama's voice on the Senate Aging Committee, I will continue to fight for our seniors to enjoy their hard-earned Social Security benefits,” he said.
