An undocumented immigrant from Colombia recently entered a controversial plea deal regarding rape charges, as reported last week. The deal was made with the office of Manhattan District Attorney Alvin Bragg, a Democrat.

The agreement involves Nicole Suarez, a 31-year-old biological male identifying as transgender, who will receive a sentence of six months in prison, which he has already served during the trial’s duration. Typically, second-degree rape in New York is punishable by two to seven years. Many are expressing outrage over the leniency of the sentence.

“Six months in prison for raping a child is a gross miscarriage of justice,” one commentator remarked.

According to the allegations, on February 11, 2025, Suarez followed a 14-year-old boy into a bodega restroom while the boy was walking his dog and assaulted him. The victim reported the crime immediately, leading to Suarez’s arrest on suspicions of first-degree rape.

Following his arrest, Immigration and Customs Enforcement (ICE) filed for his immigration detention, revealing that Suarez had entered the U.S. illegally in 2023 during the Biden administration.

Furthermore, Suarez faces various violent crime charges in Massachusetts, including armed robbery, prostitution, and assault with a dangerous weapon, as reported. The New York Post also mentioned potential outstanding charges in New Jersey.

Critics, including those from President Trump’s Department of Homeland Security, condemned the plea deal, labeling it “insane.” Acting Assistant Attorney General Lauren Biss stated that this arrangement exudes a serious failure of justice, highlighting the previous violent crimes Suarez had been charged with.

DHS noted that the New York Department of Corrections had, out of respect for ICE, opted not to release Suarez into the community. He is set to receive formal sentencing on April 27.

While Bragg’s office did not directly comment on the situation, a statement disclosed to the Daily Mail indicated that the plea deal had been discussed with the victim’s family, aiming to spare the boy from testifying.
