The Veterans Affairs Bureau (VA) has put forward new rules that would roll back regulations from the Biden administration, which allowed for abortions and abortion counseling at VA facilities.
The proposed rules require a 30-day public comment period before they can be officially adopted by the Trump administration, which will conclude on September 3, 2025.
The Biden administration had enacted rules in September 2022, enabling veterans and eligible dependents to receive taxpayer-funded abortions in cases of rape or incest, and when necessary to protect the health or life of pregnant women. These rules were a response to the Supreme Court’s decision in the Dobbs case that overturned the Roe v. Wade ruling from 1973, which had created a constitutional right to abortion.

Proposed by Trump’s VA, the new rules criticized the previous Biden policies, calling them not only “inappropriate” but also “legally questionable.” They argued that these rules strayed from over 20 years of precedent in abortion policy.
The agency emphasized:
“Legally, there’s no question that VAs hold the authority to restrict abortion services for veterans under the VA medical benefits. For years, from 1999 to 2022, the VA adhered to this approach. It was only in 2022 that the VA Secretary decided to change direction, prompted by the Supreme Court ruling.”
“The past administration used the Dobbs decision to claim federal rights to abortions for veterans, which didn’t exist before or after state laws. This was contrary to the aim of preventing overreach, and they anticipated a significant demand for VA abortions that hasn’t materialized.”
The Trump administration’s proposed rules would only permit abortions in life-threatening situations for the mother, while ensuring that treatments for ectopic pregnancies and miscarriages remain accessible.
The VA explained that Congress established the department to provide essential medical services for veterans and their families, asserting that abortion is not a necessary service unless the life of a pregnant woman is endangered.
“This proposed rule aims to realign the VA with its fundamental role as a provider of necessary medical services for those who have served our country,” stated the VA’s announcement.
