Former President Trump’s legal team is seeking a miscarriage of justice over the testimony of porn actress Stormy Daniels.
Defense attorney Todd Blanche told Judge Juan Marchand after the court’s lunch break that Daniels’ testimony Tuesday morning was prejudicial.
Blanche said prosecutors were trying to sway the jury with Daniels’ testimony, including evidence that Daniels said was not important. Blanche said Daniels has been trying to sell his story of alleged consensual sexual contact since 2016, which she said is damaging testimony and evidence.

Blanche said Daniels’ testimony on Tuesday was about “consent and risk,” which was “not the story she was selling in 2016.” Blanche also said that Daniels had testified about consent, saying such testimony “makes reversal impossible” and that the defense “objected as much as we could, but she didn’t say what she wanted to say.” “I was able to say that,” he said.
Blanche questioned how the defense could “recover from this” in a way that was “fair” to former President Trump, saying, “We believe there should be a miscarriage of justice.” “Or perhaps this witness’s testimony is excluded and extremely limited.”
Prosecutor Susan Hoffinger said in a pretrial motion that the defense was fully briefed on Stormy’s testimony and argued that Daniels’ testimony provided evidence of Trump’s intentions. Hoffinger said the defense’s attacks on Daniels’ credibility are “baseless.”
During the break, the former president and 2024 Republican presidential candidate posted on his Truth Social account without naming Daniels.
