Trump Is in Violation of the Impoundment Control Act of 1974

Sen. Tammy Baldwin (D-WI) said Monday on MSNBC's “Morning Joe” that President Donald Trump violated the Water Storage Control Act, passed in 1974.

Co-host Joe Scarborough said: Are the ongoing reservoirs by the Doge of Funds approved and allocated by Congress?

Baldwin said, “Absolutely so. And in Article 1, it's very clear that Congress will enact the law and pass the budget and spending bills. And it's the administration, the president, and they implement and manage them. And we saw the dispute there, starting with a freeze on that federal fund, and of course, the lawsuit was filed quickly, but the harm occurred. In Wisconsin, we closed 250 families in Waukesha, Wisconsin, and we moved for a week because we couldn't access federal funds to run the Head Start program. And of course, in the courts, those freezed stays. There was a withdrawal of the OMB directive.”

Scarborough said, “So I don't want to go deeper into the weeds, but I think it's important that viewers know that this appears to be unconstitutional. Congress passed the law in 1974, which is 74 water storage laws that the president explicitly states that he cannot do this.”

Baldwin said: “I think exactly, I think they're trying to break that. They'll create a case where they'll eventually take it to the Supreme Court. And I hope that the Supreme Court will withstand Article 1 and the Water Storage Act firmly.”
