Trump Seeks Alternative Route as Republicans Refuse to Assist with Nominees Delay

Trump’s Struggles with Senate Over U.S. Attorney Nominations

President Trump’s attempts to appoint loyal U.S. attorneys in the Justice Department have encountered significant challenges, largely due to court interventions and the Senate’s outdated practices. However, he seems to have alternative plans in mind.

Facing unusual obstruction, particularly from Democratic senators and the so-called “blue slip” tradition, Trump has taken steps to ensure his chosen U.S. attorneys can serve without delays typical in the confirmation process.

Utilizing temporary appointments under the Federal Vacancies Reform Act, he has claimed the presidential power to fill critical Justice Department roles amid delay tactics. Currently, 13 U.S. attorneys have been confirmed, with expectations for 18 more, but over half of his districts still require interim appointments. All of this could potentially change if Senate Judiciary Committee Chairman Chuck Grassley and Senate Majority Leader John Thune would reconsider the blue slip practice.

Following a notable incident when Trump’s mic was left on during a conversation in December, the topic of the blue slip tradition gained national attention. Now, he is eager to push for its abolishment.

Trump remarked, “The blue slip makes it nearly impossible to confirm qualified Republican judges or federal prosecutors in states where there’s at least one Democratic senator. If they say no, then that qualified candidate disappears. It seems unfair, and I call on the Senate majority to take action on this.”

The 2024 elections gave Republicans control of the White House and Congress, but only if they worked in line with voter expectations. If they don’t, they risk allowing Democrats to effectively veto Trump’s federal attorney and district judge nominations over the next several years.

Grassley has voiced concerns regarding the White House, stating, “I would like to help process more U.S. attorney nominations, but I’m waiting on necessary documents and background checks from the government.” He also urged the White House to send more nominees.

If Congressional Republicans worked to abolish the blue slip process and fully backed Trump, this could expedite confirmations, lessen the need for temporary appointments, and maintain judicial integrity without excessive political interference. Republican inaction could further politicize the courts, inviting issues that shouldn’t need resolution in the first place.
