Prosecutors Push for Trial in Charlie Kirk Murder Case
Utah prosecutors are urging the court to bring Tyler Robinson to trial concerning the murder of Charlie Kirk. They argue that the evidence against him is substantial, which complicates defense efforts to eliminate the death penalty as a possible outcome.
In a 19-page motion filed on Tuesday, the prosecutors responded to a request from Robinson’s defense team to dismiss the only aggravating factor that could lead to a death penalty sentence.
The defense maintained that the prosecution had not demonstrated that the shooting presented a significant risk of death to anyone other than Kirk. However, prosecutors contended otherwise, stating that Robinson fired a powerful rifle into a crowd of thousands, with many individuals directly in the line of fire.
They emphasized that people near Kirk were definitely within the “danger zone” created by Robinson’s actions, countering the defense’s claim that the bullet simply passed over the crowd.
Prosecutors stated, “the evidence here readily establishes at least probable cause” that Robinson presented a significant risk of death to others and claimed that this evidence is “more than sufficient to support the findings beyond a reasonable doubt.”
The prosecution also criticized the defense’s attempts to discredit evidence presented during Robinson’s preliminary hearing.
In addressing the case, they noted, “Defendant does not dispute the substance of the evidence showing that he was the one who crawled to the sniper’s perch on the roof of the Rothesay building, fired the fatal shot that killed Mr. Charlie Kirk, hid the rifle in a wooded area, removed some of the clothing he was wearing, and instructed his roommate to delete texts about the shooting.”
Additionally, prosecutors accused Robinson’s attorneys of relying on outdated case law that had been rejected by the Utah Supreme Court, which they did not disclose to the judge. They stated that this oversight is a violation of a lawyer’s duty of loyalty to the court.
The filing also addressed witness tampering allegations involving Robinson’s roommate and claims that Robinson engaged in violent behavior in the presence of children.
Evidence has emerged suggesting that Kirk was targeted due to his political views, with some shell casings reportedly engraved with the phrase “Hey, fascists, get me.”
Robinson, who is 23 years old, is accused of fatally shooting the 31-year-old Kirk as he spoke at Utah Valley University on September 10, 2025. To date, Robinson has not entered a plea regarding the charges.
Judge Tony Graf is set to determine on September 1 whether there’s sufficient probable cause to proceed with the trial.
