Teacher Arrested for Alleged Sexual Relationship with Student

Recently released police bodycam footage reveals the moment a married high school teacher in Florida guided officers through her classroom, detailing, in explicit terms, how she allegedly engaged in sexual acts with a teenage student.

The Charlotte County Sheriff’s Office announced in a statement that Heather Mashburn-Smith, 37, was arrested following an investigation by detectives.

Mashburn-Smith, who taught at Port Charlotte High School, faced charges of unlawful sexual activity with a minor. Initially, she was charged with a second-degree felony, but that charge was later elevated to a first-degree felony given her role as a teacher and her confession to police.

Charlotte County Sheriff Bill Prummell commented, saying, “What this woman has done is not just unlawful; it is damaging to the students and staff around her.” He indicated that Mashburn-Smith exploited the vulnerability of a student she was supposed to protect.

Mark Vianello, Superintendent of Charlotte County Public Schools, stated that her actions represented a serious breach of trust between educators and the communities they serve. In light of the situation, Mashburn-Smith has been placed on administrative leave.

On Thursday, bodycam footage of her arrest from April 29 was released, showing Mashburn-Smith walking detectives through the classroom, where she appears to admit her involvement with the underage student. At one point, a deputy asks her to identify where in the room the misconduct occurred.

She points to two desks and remarks, “As far as the intercourse goes, this is the desk that I leaned back on.” The footage suggests she also engaged in sexual activities on a student chair. Mashburn-Smith revealed to the officers that she would unlock the classroom for the student or prop open a side door to let him in after football practice. “We would hug and talk… it was not premeditated,” she explained.

The alleged relationship reportedly began with flirtation over Snapchat; the student had told Mashburn-Smith that she was “pretty.” According to a sworn affidavit, she invited him to her classroom for discussions about the messages, which eventually led to a flirtatious exchange. She allegedly warned the student not to tell anyone as it might lead her into trouble.

In conversations with investigators, the student revealed that they had sexual encounters on two occasions in her classroom. Following these encounters, Mashburn-Smith allegedly confided that she was unhappy in her marriage and considered leaving her husband for him when he turned 18. She reportedly told officers that the student made her feel special.

Despite the teen blocking her on social media, she continued to reach out to him through Snapchat. When confronted by deputies regarding the allegations, Mashburn-Smith admitted to making a “mistake” and acknowledged that he was just a teenager.
