Wellesley College Faces Title IX Complaint Over Transgender Admissions Policy

A complaint under Title IX has been submitted to the U.S. Department of Education, accusing Wellesley College, a women’s institution in Massachusetts, of accepting biologically male transgender students.

The college addressed these claims in a statement, emphasizing its long-standing mission to educate women and asserting that its policies comply with civil rights laws.

“Wellesley College is proud to be a women’s college that has educated women who make a difference in the world for 150 years,” the statement said.

The complaint, filed by Defending Education, a grassroots conservative nonprofit, points out that the college admits applicants who identify as women, raising concerns about discrimination based on sex. It argues that this practice undermines Wellesley’s identity as a women’s college by accepting biological males who identify as women.

Sarah Parshall Perry, a legal fellow at Defending Education, indicated that Wellesley’s policy isn’t recent, noting that it began in 2015. She mentioned that the policy clearly states on the college’s website that it welcomes biological males who identify as women.

The complaint states that Wellesley updated its admissions policy back in 2015 to include “transgender and non-binary individuals.” The college acknowledges that some students’ gender identities may change while they are enrolled.

According to Wellesley’s 2024 Gender Policy, the university asserts it will continue to function as a women’s college, stating that its educational programs are designed to benefit women specifically. The policy commits to using female pronouns and gender-based language in its communications.

The suit highlights that as of fall 2024, Wellesley College’s demographics included 1.7% male and 98.3% female students, which supporters argue reinforces its status as a women’s institution.

Perry noted that advocates for education are still trying to determine how many biological boys have been admitted under this policy. “It’s tough to figure out the exact numbers from hospitalization records,” she remarked.

Additionally, the complaint addresses concerns regarding campus facilities, stating that Wellesley’s communal bathrooms in dormitories compromise the privacy of female students.

Perry emphasized that Wellesley’s acceptance of federal funding makes it subject to Title IX requirements. She mentioned that, although Wellesley has received millions in federal funds, the university has the option to refuse such funding if they feel it conflicts with their policies.

Furthermore, from the view of Defending Education, Title IX’s references to gender should not be interpreted as encompassing gender identity. “Our longstanding documents and regulations make it clear that sex and gender identity are different concepts,” Perry elaborated.

The complaint requests that the Office for Civil Rights investigate Wellesley and mandate changes to its policies, which advocates argue are unlawful. “If Wellesley College truly wants to be a women’s college, we will do everything we can to ensure protections for biological women,” Perry asserted.
