Court documents that are part of a lawsuit against the Biden administration over Title IX expansion allege that a transgender middle school athlete in West Virginia has expelled female athletes from competition more than 700 times.
The document’s claims represent a key element of the lawsuit, which seeks to remedy how Title IX changes introduced by Education Secretary Miguel Cardona actually impact girls’ and women’s sports.
In April, Cardona expanded Title IX to include discrimination based on gender identity and sexual orientation. However, the government maintains that the rule changes will not affect women’s sports.

Encouraged by a report from West Virginia, the nonprofit civil rights organization Alliance Defending Freedom (ADF) is blocking implementation of Biden’s Title IX rule changes, scheduled to go into effect on August 1, and It seeks to uphold state laws prohibiting . “The Biden administration’s fundamental redefinition of gender upends the equal opportunities women and girls have enjoyed for 50 years under Title IX, and will continue to protect women and girls at every level,” ADF Senior Advisor Rachel Rouleau said in a statement. Biden’s commitment to transgender inclusion has had a direct impact on ADF’s clients.
A federal court has ruled against the ADF, which sought to prevent transgender athletes from competing against women. As a result, according to the document, the trans athlete defeated more than 700 girls in track and field competitions.

Rolleau said the federal court’s ruling against his client not only hurt female athletes on the field, but also put them in an awkward and dangerous position in the locker room.
“Our client also lost the right to use the women’s locker room without harassment or male presence. This egregious example is due to illegal rewriting of federal law and broad overreach of executive power that girls are now is just one of the many challenges facing the country,” explained Mr Rolleau.
ADF’s legal action is part of a broader coalition of 20 states launched by Tennessee Attorney General John Scumetti to assert states’ rights to block men from girls’ and women’s sports. It is said that
