West Virgina Trans Athlete Defeated Girls in Track Events over 700 Times, Court Doc Claims

Court documents that are part of a lawsuit against the Biden administration over Title IX expansion allege that a transgender middle school athlete in West Virginia has expelled female athletes from competition more than 700 times.

The document’s claims represent a key element of the lawsuit, which seeks to remedy how Title IX changes introduced by Education Secretary Miguel Cardona actually impact girls’ and women’s sports.

In April, Cardona expanded Title IX to include discrimination based on gender identity and sexual orientation. However, the government maintains that the rule changes will not affect women’s sports.

Encouraged by a report from West Virginia, the nonprofit civil rights organization Alliance Defending Freedom (ADF) is blocking implementation of Biden’s Title IX rule changes, scheduled to go into effect on August 1, and It seeks to uphold state laws prohibiting . Laws barring athletes from playing on women’s sports teams will remain in those states.

“The Biden administration’s fundamental redefinition of gender upends the equal opportunities women and girls have enjoyed for 50 years under Title IX, and will continue to protect women and girls at every level,” ADF Senior Advisor Rachel Rouleau said in a statement. It threatens the safety and privacy of people.”

“While the administration maintains that this change will not affect sports, it has already made clear its position that men who identify as women should participate in women’s sports under Title IX,” Rouleau said. he added.

Biden’s commitment to transgender inclusion has had a direct impact on ADF’s clients.

A federal court has ruled against the ADF, which sought to prevent transgender athletes from competing against women. As a result, according to the document, the trans athlete defeated more than 700 girls in track and field competitions.

Rolleau said the federal court’s ruling against his client not only hurt female athletes on the field, but also put them in an awkward and dangerous position in the locker room.

“Our client also lost the right to use the women’s locker room without harassment or male presence. This egregious example is due to illegal rewriting of federal law and broad overreach of executive power that girls are now is just one of the many challenges facing the country,” explained Mr Rolleau.

ADF’s legal action is part of a broader coalition of 20 states launched by Tennessee Attorney General John Scumetti to assert states’ rights to block men from girls’ and women’s sports. It is said that

“Fifty years ago, Congress revolutionized our nation’s education system,” the ADF motion states. “In 1970, almost 34% of working women did not have a high school diploma. In 2016, it was 6%. In 1972, 7% of high school varsity athletes were women. 2018 This change occurred because the people’s representatives balanced various interests and enacted legislation centered on the 37 words. [Title IX Of The Education Amendments Of 1972]: No person shall be excluded from, denied the benefits of, or subjected to discrimination on the basis of gender. ”

“A different kind of revolution occurred a few weeks ago. On April 29, unelected Department of Education officials announced a new law that would add the concept of gender identity, or “an individual’s sense of their gender.” Part IX regulations have been announced. The new rules sometimes prioritize this subjective concept over someone’s objective gender, allowing some men to use the women’s restroom, change in the women’s locker room, shower in the women’s shower, or Requires schools to allow students to participate in sports,” the motion states.

“As a result, Title IX’s primary beneficiaries are denied the privacy, dignity, equality and fairness they need to benefit from our education system.

“None of this is justified and cannot be justified.”
