Georgia attorney Andrew Fleischman published an opinion piece in the left-leaning Daily Beast on Tuesday, arguing that allegations made by Fulton County District Attorney Fani Willis to benefit the special prosecutor and his girlfriend are true. He said he should resign.
Mr. Fleischman is a partner at Sessions & Fleischman. I have written In his article titled “Why we can't ignore the Fani Willis scandal,'' he says:
If the prosecutor's office prosecuting Trump extended the investigation to justify a high payout for his girlfriend, that would be a true conflict of interest and would require Trump to be removed from office.
Willis, who is prosecuting former President Donald Trump in Fulton County, allegedly hired special prosecutor Nathan Wade, a man she is said to be dating, and paid him nearly $700,000 and received time off in return. If so, Willis should be fired, he wrote.
He noted that Willis did not dispute the allegations. he wrote:
After the allegations became public, Willis gave a speech denouncing expectations of black women to be perfect and comparing herself to Martin Luther King Jr., whose personal life was also tormented by political opponents. She argued that race, not Wade's limited criminal trial experience, was the basis for public skepticism, and that the public had not scrutinized the qualifications of the other two special prosecutors, who are white. It pointed out.
Mr. Fleischman argued that the other two special prosecutors are “incredibly qualified” but earn less than Mr. Wade, writing:
…Anna Cross is a former DeKalb County Assistant District Attorney who handled dozens of felony appeals and argued significant claims in Fulton County. John Floyd is widely considered Georgia's leading authority on state RICO prosecutions and helped draft the bill. In total, he was charged $116,000 (less than a quarter of Wade's total). And according to the agreement obtained by the Daily Caller, Mr. Floyd was paid about $100 an hour less than Mr. Wade.
Mr. Fleischman disputed Mr. Willis' argument that Mr. Wade was competent because he was hired as a special prosecutor by a white Republican when Cobb County hired him to investigate a prison death. Rejected.
He said, “…local news outlets successfully argued that this investigation was initiated solely to prevent members of the public from filing open records requests in the death case.”
Mr. Fleischman also noted that Mr. Wade's wife filed for divorce the day after he hired Mr. Willis.

He also noted that Wade filed for divorce from his wife the day after he hired Willis.
“But even though he is undoubtedly the best possible person for the role, he is being paid $654,000, and Willis, in hindsight, needed him throughout the prosecution.” “I have made choices that seem calculated to do so,” he wrote.
Mr. Fleischmanbun, who is not a fan of President Trump, said Mr. Willis' hiring of Mr. Wade to gather evidence was rare and likely would delay Mr. Trump's trial before the November election.
“…Wade was used extensively during special grand jury proceedings and made hundreds of thousands of dollars helping to facilitate them.” As Fulton County struggles to bring the former president to justice ahead of the November election, We are now seeing the cost of these delays,” he wrote.
Mr. Fleischman also noted Mr. Willis' shaky history with conflicts of interest, including the 2022 decision by Superior Court Judge Fulton for supporting Fannie Willis's political opponent, Democrat Charlie Bailey. He wrote that he had disqualified the county's Lt. Gov. Bert Jones as chief prosecutor.
.@repmtg Here's hoping Gov. Brian Kemp responds to the bombshell about sloppy Fani Willis. “This is not political at all…If he ignores this, he is showing extreme political bias.” https://t.co/BY2iEQoJwZ

“In the order, the judge notes that there was an ‘actual’ conflict of interest. …The conflict is real as there is a public criminal investigation.” [then-]”Senator Jones clearly benefits Bailey's campaign and openly supports the district attorney,” he wrote.
Fleischmann writes:
The criterion for disqualifying Fulton County here is not whether Fani Willis actually made decisions to benefit Nathan Wade. It's entirely possible that she would have made the exact same choice had it not been for the personal relationship. But if her choice to prolong or prolong her investigation benefits her lover, who pays for her meals and vacations, that is a real contradiction.
Fleischmann said that when a Georgia judge was caught having sex with a public defender outside the courthouse, the court determined that the sexual encounter required a new trial for the defendant. he pointed out.
“Here, too, the defendant's guilt or innocence was irrelevant. A new trial was necessary because of the conflict of interest,” he wrote.
He said Superior Court Judge Scott McAfee would likely disqualify Willis and his entire office in February, which would make it difficult to try Trump before the 2024 election. I expected it to be loud.
“But even if everything goes as smoothly as humanly possible, it's hard to imagine trying a former president before the November election. And it's possible that this case could end up in the hands of someone who chooses to dismiss it.” There’s also sexuality,” he said.
