WV official not cited for erratic driving; incident under investigation

West Virginia State Police announced Wednesday that they are investigating a traffic stop in which a state officer was stopped for driving erratically but was allowed to continue operating the vehicle without being charged. .

Charleston Police Chief Scott Dempsey said in a statement that officers conducted a traffic stop on southbound Interstate 77 Tuesday night after an off-duty state trooper reported seeing a vehicle in the city’s east end. He said he had done so.

The statement identified the driver of the stopped vehicle as Jimmy Liston. Gov. Jim Justice confirmed during his weekly news conference Wednesday that the driver who was pulled over was state Transportation Secretary Jimmy Liston.

Liston has not been charged or charged with any traffic or criminal offenses, according to a police statement.

However, Dempsey said, “Due to the circumstances surrounding the traffic stop, an internal investigation has been initiated to determine whether Charleston Police Department policies were appropriately followed.”

An email seeking comment from a Department of Transportation spokesperson was not immediately returned Wednesday.

The judge said he had been informed of the traffic stop and said he was “certain to get to the bottom of it.”
