xAI Sues Man for Allegedly Misusing AI System
Elon Musk’s artificial intelligence company, xAI, has filed a lawsuit against a South Carolina man, accused of exploiting its AI system, Grok, to create materials that involve the sexual abuse of minors. This legal action follows the man’s earlier arrest on allegations related to such abuses earlier this year.
The lawsuit was submitted in a Texas federal court on Tuesday, claiming violations of xAI’s terms of service. It’s noteworthy that this is among the first lawsuits initiated by an AI company against an individual user for allegedly generating explicit content through its system.
This situation has come to light during a period of increased scrutiny towards xAI, specifically concerning claims that Grok facilitated the generation of non-consensual sexual deepfake imagery and videos. xAI has stated that they actively enforce their rules by suspending accounts and reporting any suspected child sexual abuse material to the National Center for Missing and Exploited Children.
In the complaint, the company claimed that, in 2026 alone, they suspended over 52,000 accounts and filed more than 73,000 reports to NCMEC, leading to at least 244 arrests. The lawsuit alleges that the defendant, Terry Harwood, used Grok to upload non-sexual images of both adults and minors, aiming to create sexually explicit deepfakes. It also asserts that he created sexual images of adults without their consent.
While Harwood’s contact details were not available at the time of his arrest in February, an xAI representative did not provide any immediate comments when contacted. The lawsuit seeks unspecified monetary damages and a court order to prevent Harwood from further use of the Grok system.
xAI emphasizes that Harwood’s actions represented a calculated attempt to exploit their tools for illegal purposes, threatening both the company’s legal standing and the dignity of actual victims involved.
