President Joe Biden’s Department of Homeland Security (DHS) monitors less than 1.5% of the country’s illegal immigrant population, but roughly 99% of those who cross the border illegally are living freely across the United States, the report said.
The federal data, compiled by the National Center for Immigration Enforcement (NICE) and distributed by several Republican members of the House and Senate, examines the entire illegal immigrant population living in American communities, currently estimated at about 17 million people.
Of the millions of illegal immigrants in the United States and those who have crossed the border, approximately 1.34% are in Immigration and Customs Enforcement (ICE) custody or monitored through the Intensive Supervision Appearance Program (ISAP).
Meanwhile, as Breitbart News reported last week, about 7.4 million border crossers are currently on ICE’s so-called “non-detainer list” — border crossers known to the Biden administration who live throughout the United States but are not in ICE custody.
Fewer than 2.5 percent of suspects not in custody are under ISAP monitoring.

House Speaker Mike Johnson (R-Louisiana) accused Biden of trying to mislead the American people about illegal immigration. write “Ninety-nine percent of illegal immigrants in America roam free… Let’s not forget that this is the state of our southern border under his leadership.”
“Of the approximately 17 million illegal immigrants currently in the United States, 99 percent are roaming freely without any oversight from the Biden administration. [administration]Senator Bill Hagerty (R-TN) Said Statistics show that “only 1% are actually monitored. Only 0.25% are detained. This is not sustainable.”
Hagerty introduced the Alternatives to Detention Reform Act with Rep. Byron Donald (R-Fla.), which would require the Department of Homeland Security to use all available detention space for migrants crossing the border. Once all space is used, the bill would require DHS to enroll migrants awaiting deportation hearings in ISAP, which uses GPS monitoring.
The bill aims to ensure that all immigrants on ICE’s non-custodial list are enrolled in ISAP so that immigration authorities can know where they are if they abscond from the program or are ordered deported from the United States by a federal immigration judge.
If current trends continue, more than 8 million immigrants are expected to be on ICE’s non-detainer list by the end of the year, the vast majority of whom will not be monitored through ISAP.
