Brady Kiser, the husband of influencer Emily Kaiser, will not face child abuse charges following the tragic death of their 3-year-old son.

The couple’s son, Trigg, died a few days after being found unresponsive in the swimming pool at their Arizona home back in May.

At the time of the incident, Brady stated to investigators that he was “distracted” by their newborn while Trigg was in the backyard pool that he had dug out.

Although investigators from the Chandler Police Department initially suggested that Brady be charged with a class 4 felony for child abuse, a comprehensive investigation by the Maricopa County Attorney’s Office concluded there wasn’t enough evidence to proceed with charges.

“Maricopa County Attorney Rachel Mitchell announced today that Brady Kiser will not face charges related to his son’s drowning because there’s no reasonable chance of securing a conviction,” said an official statement. “Video evidence from outside the home clarified the timeline of events leading up to the tragedy.”

In order to secure a conviction, prosecutors would need to prove beyond a reasonable doubt that Brady failed to recognize a significant risk, which was deemed unlikely in this situation.

The office also indicated that all reviewed cases were evaluated for their potential for a conviction, and in this instance, it fell short of that standard. They noted they couldn’t share further details due to court orders.

More than two months have passed since Trigg’s death on May 18. Hospital officials confirmed that he died from his injuries after being hospitalized on May 12.

On May 27, Emily filed a lawsuit in Arizona Superior Court, seeking to keep all records related to her son’s death, including any distressing footage, out of the public eye.

Emily, a 26-year-old blogger, was with a friend when the unfortunate incident occurred, where she found Brady unresponsive regarding their child.

With 3.1 million followers on TikTok and over a million on Instagram, Emily gained attention for sharing daily updates about her life. She and Brady welcomed Trigg in July 2021 and had their second son, Teddy, in March.
