Florida’s Republican Governor Ron DeSantis has shown wary skepticism towards artificial intelligence, a stark contrast to the Trump administration’s enthusiastic embrace of AI technologies. While Trump showcases massive private sector investments in AI, framing them as crucial in the tech race against China, DeSantis warns of AI’s potential dangers, advocating for stricter regulatory measures.
He argues that limiting AI regulations to the federal level is vital for fostering a robust American AI industry. DeSantis believes that the increasing number of state laws threatens a cohesive national framework, which, in turn, imposes costs and complicates compliance for both innovators and consumers.
There’s talk of a moratorium on AI regulations as part of the discussion surrounding significant legislation. This measure could help eliminate overlapping state and federal policies, paving the way for Congress to establish a coherent regulatory framework regarding AI.

For instance, Pennsylvania recently enacted SB 1213, which bans the use of AI in creating non-consensual explicit images. Yet, federal law already prohibits the distribution of such images created by AI, forcing companies to navigate a conflicting legal landscape.
This lack of uniformity undermines not just businesses but also consumer confidence, as differing laws create legal uncertainty. As industries evolve, the experience can feel, frankly, quite chaotic.
Innovation at Stake
As with previous technological advancements, an influx of state-level regulations may jeopardize the administration’s goal of maintaining a light regulatory touch. Every new law can prompt added compliance demands, whether or not they conflict with existing federal regulations.
If the Trump administration is genuinely committed to fostering innovation and strengthening its agenda, it should advocate for a moratorium on inconsistent state-level AI regulations.
